19940913 1994-19ORDINANCE NO. 1994-19 AN ORDINANCE AMENDING SECTION 17-7 (b) AND (c), ARTICLE I, CHAPTER 17 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, CONCERNING TESTS FOR FITNESS REGARDING EMPLOYMENT WITH THE CITY OF FAIRFAX BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that Section 17-7(b) and (c), Article I, Chapter 17 of the Code of the City of Fairfax, is hereby amended to read as follows: Sec. 17-7. Recruitment and selection. (b) Tests for fitness. In order to determine their capacity or fitness for a position, applicants may be required to take examinations which may include written and oral tests. Applicants for public safety positions may be required to take polygraph examinations. Applicants for public safety positions and positions where drug use could have an adverse impact on the public or the applicant's job performance may be required to undergo drug testing. Additionally, once employed, said employees may be required to undergo drug testing during regularly scheduled physical examinations and/or where there is a reasonable ground to suspect drug use by the employee. Waivers of eligibility for disability retirement benefits may be required for pre-existing conditions discovered by any physical examination. However, waivers of disability benefits shall not be deemed to avoid the minimum physical standards for any positions. (c) As a condition of a final offer of employment, persons may be required to successfully complete physical and psychological tests, and execute agreements providing for continued compliance with city and/or departmental policies regarding job standards, such as physical fitness requirements and non-smoking requirements. BE IT FURTHER ORDAINED that the remaining subsections of the section hereby amended shall continue to read as previously enacted. 3. This ordinance shall become effective as provided by law.
