19940927 1994-22ORDINANCE NO. 1994-22 AN ORDINANCE TO APPROVE A ZONING MAP AMENDMENT FROM R-2 (RESIDENTIAL) TO I-2 (INDUSTRIAL) FOR THE PROPERTY KNOWN AS THE CITY PROPERTY YARD AND IDENTIFIED AS A PORTION OF TAX MAP PARCEL 58-1-((2))-28. WHEREAS, the City of Fairfax, Virginia, by Robert Sisson, Agent and City Manager, submitted application Z-757-94-1 requesting approval of a zoning map amendment for the parcels identified above, and more specifically described as follows: Beginning at an iron pipe found on the westerly right-of-way line of State Route Number 237, Pickett Road (variable width), said point being a common corner with the land of Army Navy Country Club; Thence running with the line of the land of Army Navy Country Club the following two courses and distances: 1.) S84°27'35"W 1,028.88 feet to a concrete monument found; 2.) Thence N07°47'25"W, passing through a concrete monument found at 290.72 feet, 318.80 feet to an iron rod set, said point lying in Accotink Creek; Thence running consecutively with the line of the lands of the City of Fairfax, V!,r, ginia and National Asphalt Manufacturing Corporation N63°08;35 E 471.70 feet to a brick nail set in the concrete of a fence post; Thence running consecutively with the line of the lands of National Asphalt Manufacturing Corporation and D.A. Foster Maintenance Corporation N89°18'35"E 274.40 feet to an iron rod set; Thence continuing with the line of the land of D.A. Foster Maintenance Corporation N35°18'35"E 112.00 feet to an iron rod set; Thence running consecutively with the line of the land of D.A. Foster Maintenance Corporation and with land dedicated to public use for Old Pickett Road in deed book 1908 at page 135 S60°26'25"E 275.03 feet to an iron rod set, said point lying in the westerly right-of-way line of the aforementioned Pickett Road; Thence running with the westerly right-of-way line of Pickett Road the following three courses and distances: 1.) S20°32'02"E 102.89 feet to an iron rod set; 2.) Thence S07°33'37"E 268.25 feet to an iron rod set; 3.) Thence with a curve to the left of radius 1,955.86 feet having a central angle of 00°46'42'', chord of 26.57 feet, chord bearing of S07°03'55"W and an arc length of 26.57 feet to the point and place of beginning and containing 10.5757 acres of land more or less; and 1944-22 Beginning at a point being a common corner with the land of D.A. Foster Maintenance Corporation (D.B. 6929, PG. 565), said point lying in the line of the land of the City of Fairfax, Virginia (D.B. 460, PG. 404 and D.B. 1581, Pg. 262) and being the southwest comer of the parcel herein described; Thence from the point of beginning running with the line of the land of D.A. Foster Maintenance Corporation N19°15'25"W 95.62 feet to a point; Thence leaving the line of D.A. Foster Maintenance Corporation and running through the dedication fro public use (D.B. 1908, PG. 135) N51°17'41"E 10.60 feet to a point; Thence running with the easterly line of said dedication S19°15'25"E 110.88 feet to a point, said point lying on the westerly right-of-way line of Pickett Road, State Route Number 237 (variable width) (D.B. 5631, PG. 103); Thence running consecutively with the right-of-way line of Pickett Road and with the line of the land of the City of Fairfax, Virginia (D.B. 460, PG. 404 and D.B. 1581, PG. 262) N60°26'25"W 15.19 feet to the point and place of beginning and containing 0.0237 acres of land more or less; and Beginning at a point being a common corner with a 10' wide strip of land dedicated for public use for the widening of Old Pickett Road formerly Schuerman Road (now abandoned) in deed book 1908 at page 135, said point lying on the westerly right-of-way line of Pickett Road, State Route Number 237 (variable width); Thence from the point of beginning running with the easterly line of the aforementioned 10' wide dedication N19°15'25"W 110.88 feet to a point; Thence leaving said dedication line and running N51°17'41"E 9.48 feet to a point and N77°57'30"E 6.11 feet to a point, said point lying in the line of the land of the City of Fairfax, Virginia (D.B. 2949, PG. 622) and being the centerline of Old Pickett Road formerly Schuerman Road; Thence running consecutively with the line of the land of the City of Fairfax, Virginia and with the westerly right-of-way line of Pickett Road, State Route Number 237 S19°15'25"E 130.41 feet to a point; Thence continuing with the westerly right-of-way line of Pickett Road, State Route Number 237 N60°26'25"W 22.78 feet to the point and place of beginning containing 0.0418 acres of land more or less; and Beginning at a point being an angle point in the westerly right-of-way line of Pickett Road, State Road Number 237 (variable width) (D.B. 5631, PG. 103), said point lying along the centerline of Old Pickett Road formerly Schuerman Road (now abandoned); -2 1994-22 -3 Thence from the point of beginning running with the centerline of Old Pickett Road formerly Schuerman Road N19°15'25"W 90.90 feet to a point; Thence leaving said centerline and running through the land of the City of Fairfax, Virginia (D.B. 2949, PG. 622) the following four courses and distances: 1.) N77°57'30"E 46.27 feet to a point; 2.) Thence N57°00'00"E 30.85 feet to a point: 3.) Thence N71°22'46"E 55.37 feet to a point; 4.) Thence N70°50'13"E 103.81 feet to a point, said point lying on the aforementioned westerly right-of-way line of Pickett Road; Thence running with the westerly right-of-way line of Pickett Road the following eight courses and distances: 1.) With a curve to the right of radius 1,384.39 feet having a central angle of 02°52'07'', chord of 69.31 feet, chord bearing of S16°02'00"W and an arc length of 69.32 feet to a point; 2.) Thence containing N72°31'56"W 17.00 feet to a point: S28°46'40"W 25.50 feet to a point; S01°49'20"E 21.19 feet to a point; S19°06'16"W 35.01 feet to a point; S85°34'56"W 126.09 feet to a point; S39°59'14"W 6.09 feet to the point and place of beginning and 0.4481 acres of land more or less; and WHEREAS, the City Council has carefully considered the application, the recommendation of the Planning Commission and staff, and the testimony received at public hearing; and WHEREAS, the City Council has determined that the proposed approvals and amendments are proper and in accordance with the Comprehensive Plan as well as the pertinent provisions set forth in the Code of Virginia and the Code of the City of Fairfax; NOW, THEREFORE, BE IT ORDAINED, that the above described property be rezoned from R-2 to I-2 and the application be approved subject to the following reasonable condition authorized by City Code Section 26-6, which is proffered by the property owner: Future uses of the Property shall be restricted to property yard uses. The Zoning Administrator of the City is hereby directed to modify the Zoning map to show the changes in the zoning of these premises, including the existence of a condition, and the Clerk of the Council is directed to transmit duly certified 1994-22 -4 copies of this ordinance to the applicant, Zoning Administrator, and to the Planning Commission of this City as soon as possible.
