19930209 1993-3ORDINANCE No. 1993-3 AN ORDINANCE TO AMEND ARTICLE, I, SECTION 26-4, DEFINITIONS, TO INCREASE FROM FOUR (4) TO SIX (6) THE NUMBER OF CHILDREN CONSTITUTING A "NURSERY SCHOOL" (DAY CARE CENTER). WHEREAS, the home child care facilities serving children five years of and under are comprehensively regulated in Chapter 11.01; and WHEREAS, home child care facilities of this size have little or no negative impact on surrounding neighborhoods; NOT, THEREFORE, BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that Article I, Section 26-4, Definitions, "Nursery School" of the Code of the City of Fairfax is hereby amended to read in it entirety as follows: Nursery school: Any place, however designated, operated for the purpose of providing training, guidance, education or care for six (6) or more children, none of whom is over six (6) years of age, separated from their parents or guardians during any part of the day other than from 6:00 p.m. to 6:00 a.m., including kindergartens, day nurseries and day care centers. A nursery school shall not be deemed a major or minor home occupation. This ordinance shall be effective as provided by law.
