19930309 1993-13ORDINANCE NO. 1993-13 AN ORDINANCE TO AMEND SECTION 8-60, ARTICLE XI, CHAPTER 8 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, CONCERNING AMENDING THE DEFINITION OF MEALS TO INCLUDE PREPARED FOOD AND DRINK, ADDING THERETO CERTAIN EXCEPTIONS, AND AMENDING THE DEFINITION OF RESTAURANT TO INCLUDE CONVENIENCE STORES, GROCERY STORES AND SUPERMARKETS. BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that Section 8-60, Article XI, Chapter 8 of the Code of the City of Fairfax, Virginia, is hereby amended to read in its entirety as follows: Sec. 8-60. Definitions. For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section: Meal. All prepared food and drink, .......... ~ .......... ~, offered for sale in a form ready for consumption on or off the seller's premises. The term "drink" shall include, but not be limited to, alcoholic beverages. The term "meal" shall not be deemed to include food or drink sold through vending machines or on any tangible personal property purchased with food Coupons issued by the U.s. Department of Agriculture under the Food Stamp Program or drafts issued through the Virginia Supplemental Food Program for Women, Infants and Children. In addition, no blind person operating a vending stand or other business enterprise under the jurisdiction of the Department for the Visually Handicapped and located on property acquired and used by the United States for any military or naval purpose shall be required to collect and remit meals taxes. Further, the term "meal" shall not be deemed to include food or drink sold by any nonprofit or government subsidized school or institution of learning to its students or employees. Purchaser. Any person who purchases a meal. Restaurant. Any place located in the city from or in which meals are sold, including, but not limited to, drugstores, eating houses, public and private clubs, bars, cafeterias, convenience stores, qrocery stores, supermarkets, grills, diners, dining rooms, eateries and places of business known as restaurants, including fast-food and drink-in restaurants. ................ off .. =-~ = --6 -~d" ~ .......... 6= h ii Seller.
