19920324 1992-5ORDINANCE NO. 1992-5 AN ORDINANCE TO AMEND SECTIONS 26-45(d), 26-46(c) and (f), AND 26-48.1(i), AND TO ADD SECTIONS 26-45(g) and 26- 48.1(m) ARTICLE II, DIVISION 7 (SIGNS) OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, TO AMEND REGULATIONS PERTAINING TO TEMPORARY SIGNS, PROHIBITED SIGNS AND SIGNS NOT REQUIRING PERMITS. WHEREAS, the City seeks to stimulate economic revitalization and maintain and enhance the City's distinctive identity by providing adequate but not excessive flexibility in permitted signage, NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Fairfax, Virginia that Section 26-45(d) Article II, Division 7 (Signs) of the Code of the City of Fairfax, Virginia, is hereby amended to read as follows: Sec. 26-45. Temporary Signs (d) Business openings and sales events signs. Signs, including banners, advertising special sales events; provided such permits shall be limited to ten (10) consecutive days' duration and four (4) events per year for any one business establishment. Signs, including banners, not to exceed thirty-two (32) square feet, for openings or closings of business establishments; provided such permits shall be limited to three (3) months' duration per opening sign and to one (1) month's duration per closing sign. No moving signs or devices as described in section 26-46(c) shall be permitted for business openings and sales events. BE IT FURTHER ORDAINED that Section 26-45 be amended to add thereto a new subsection (g) to read as follows: (g) special events sponsored by merchants' or other commercial organizations. Signs, including banners, flags or balloons, for special events sponsored by merchants' or other commercial organizations provided: (1) permits for signs and banners shall be limited to ten (10) consecutive days' duration and six (6) events per year for any one merchants' or commercial organization. Flags and balloons shall be limited to three (3) consecutive days' duration and six (6) events per year for any one merchants' or commercial organization; and, (2) notwithstanding the identity of the special event sponsor, no banners, flags or balloons shall be displayed on any lot in excess of the duration and frequency limits set forth above in subsection (1). BE IT FURTHER ORDAINED that Section 26-46(c) and (f) be amended to read in their entirety as follows: Sec. 26-46. Prohibited signs. (c) Moving signs or devices intended to attract attention, all or any part of which is intended to move, including but not limited to flags (including pennants), balloons, propellers and discs except as 1992-5 -2 provided for in sections 26-44(b)(4), 26-45(g) and 26-48. l(d)(i) and (~ Temporary signs and banners except as expressly permitted in sections 26-45 (temporary signs) and 26-48.1(i) and (m) (signs not requiring a permit). BE IT FURTHER ORDAINED that Section 26-48.1(i) be amended to read as follows: Sec. 26-48.1. Signs not requiring permits. (i) Banners, flags, balloons and nonilluminated signs posted by civic, fraternal, charitable or public service organizations provided: (1) such banners and nonilluminated signs shall be limited to ten (10) consecutive days' duration and six (6) events per year for any civic, fraternal, charitable or public service organization. Flags and balloons shall be limited to three (3) consecutive days' duration and six (6) events per year for any civic, fraternal, charitable or public service organization; and, (2) notwithstanding the identity of the special event sponsor, no banners, flags or balloons shall be displayed on any lot in excess of the duration and frequency limits set forth above in subsection (1). Notwithstanding the provisions of section 26-43(a) which regulate sign location such signs may be no closer than eight (8) feet from the street curb or the edge of street pavement in the absence of a curb subject to the approval of the city manager or his designee to insure vehicular and pedestrian safety. BE IT FURTHER ORDAINED that Section 26-48.1 be amended to add thereto a new subsection (m) to read as follows: (m) Banners, flags and balloons for private use in celebration of special events in residential districts shall be limited to three (3) consecutive days' duration. BE IT FURTHER ORDAINED that the remaining subsections of the sections hereby amended shall continue to read as previously enacted. This ordinance shall become effective as provided by law.
