19920526 1992-12ORDINANCE NO. 1992- 12 AN ORDINANCE TO AMEND CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, BY AMENDING THE ZONING MAP TO RECLASSIFY FROM R-2, RESIDENTIAL, TO R-3 RESIDENTIAL, THE PROPERTY KNOWN AS 3622 CHAIN BRIDGE ROAD, AND MORE PARTICULARLY IDENTIFIED AS CITY OF FAIRFAX TAXMAP PARCEL 57-2-((2))-116. WHEREAS, W. Rembert and Jo Sue L. Simpson submitted applica- tion No. Z-742-92-1 requesting a change in the zoning classifica- tion from R-2 to R-3 for the parcel identified above, and more specifically described as follows: Beginning at a point lying at the intersection of a westerly line of Chain Bridge Road, State Route 123, (variable width) with a southerly line of Warwick Avenue (30 feet wide), said point being the northeast corner of the land hereindescribed; thence from the point of beginning and running with said westerly line of Chain Bridge Road S05°02'W 120.38 feet to a point, said point being a corner between part of Lots 1 and 2, John W. Rust's Subdivision of the B.F.A. Myers' Farm and the land hereindescribed; thence departing aforesaid westerly line of Chain Bridge Road and running with the dividing line between part of Lots 1 and 2 and the land hereindescribed N85°20'W 326.50 feet to a point, said point being a corner between part of Lot 3 and Lot 94, John W. Rust's Subdivision of the B.F.A. Myers' Farm and the land hereindescribed; thence running with the dividing line between part of Lot 3 and Lot 94 and the land hereindescribed N05°02'E 151.70 feet to a point lying in a southerly line of aforesaid Warwick Avenue, said point being the northwest corner of the land herein- described; thence running with said southerly line of Warwick Avenue S79°51'E 327.80 feet to the point and place of beginn- ing, containing 44,416 square feet of land, more or less, and being in accordance with a plat for rezoning hereto attached and being a part thereof; and WHEREAS, the City Council has carefully considered the application, the recommendation of the Planning Commission and staff, and the testimony received at public hearing; and WHEREAS, the City Council has determined that the proposed rezoning is proper and in accordance with the Comprehensive Plan as well as with the pertinent provisions set forth in the Code of Virginia and the Code of the City of Fairfax, Virginia; NOW, THEREFORE, BE IT ORDAINED that the above described property be rezoned from R-2, Residential, to R-3, Residential. The Zoning Administrator of the City is hereby directed to modify the Zoning map to show the changes in the zoning of these premises and the Clerk of the Council is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator, and to the Planning Commission of this City as soon as possible. 1992-12 -2- This ordinance shall be effective as provided by law.
