19910312 1991-5ORDINANCE NO. 1991- AN ORDINANCE AMENDING SECTIONS 13-2(a), 13-16 AND 13-22(f), ARTICLE II, CHAPTER 13 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, CONCERNING POWERS OF THE CITY MANAGER, REGULATION OF TRAFFIC IN PARKING LOTS AND PERMITS FOR VEHICLES OF EXCESSIVE SIZE AND WEIGHT. BE IT ORDAINED that Sections 13-2(a), 13-16 and 13-22(f), Article II, Chapter 13 of the Code of the City of Fairfax, Virginia, are hereby amended to read as follows: Section 13-2. powers of city manager. (a) The city manager, with the advice of the chief of police and director of public works and to secure, preserve, and promote safety, welfare, comfort, convenience, trade, commerce, and industry within the City, shall regulate the operation of motor vehicles on the streets, highways, and alleys of the City by directing the location and placement of appropriate signs and markings showing the rules and regulations applicable to the operation of motor vehicles. Such rules, regulations, signs, and markings shall comply with the requirements of Virginia Code, section ~ 46.2-1300, et seq., and shall not conflict with the provisions of any other ordinance in the Code of the City of Fairfax pertaining to the operation of motor vehicles. Section 13-16. Regulation of traffic on certain parking lots. In addition to ordinances specifically applicable to the regulation of vehicular traffic on parking lots, the following section shall apply to vehicular traffic on parking lots open to the public and designed to accommodate fifty (50) or more vehicles: Sections A~ ~_..~ A~ ~ .~ ~ ~ ~ ...... ~, Ac ._.~.. and 46.2-1309, 46.2-852, 46.2-853 through 46.2-864, 46.2-865, 46.2-866, 46.2-817, 46.2-811, 46.2-837, 46.2-816, 46.2-820 through 46.2-825 of the Code of Virginia as adopted by this chapter and sections 13- 17, 13-18, 13-19, and 13-20 of the Code. Section 13-22. Permits required for vehicles of excessive size and weight--Generally. (f) The city manager, upon application in writing made by the owners or operators of motor vehicles not exceeding the axle and gross weight limitations as set forth in Section~ ~ 46.2- 1122 through 46.2-1127 of the Code of Virginia, shall issue, without cost, a permit authorizing the operation of such motor vehicles on the highways of the City, to transport items arriving at a Virginia port by ship from overseas points of origin and consigned to an assembly plant in this state, on motor vehicles that do not exceed the height limitation set forth in Section 4~.1 ~29 46.2-1110 of the Code of Virginia by more than One and one-half feet and not exceeding the length limitation as set forth in Section~ ~ 46.2-1112, 46.2-1113 and 46.2-1153 of the Code of Virginia by more than three feet. The city manager may designate the routes such permitees must use from the port to the assembly plant. 1991-5 BE IT FURTHER ORDAINED that the remaining subsections of the sections hereby amended shall continue to read as previously enacted.
