19910514 1991-10ORDINANCE NO. 1991-10 AN ORDINANCE AMENDING SECTION 26-209.2, DIVISION 2, ARTICLE XVIII, CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, BY ADDING A NEW SUBSECTION (d) CONCERNING TEMPORARY SPECIAL USE PERMITS IN THE CPD, Cl-L, C-1 AND C-2 DISTRICTS WITHIN THE OLD TOWN HISTORIC DISTRICT AND AMENDING SECTION 26-213.1, ARTICLE XIX, CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, BY ADDING A NEW SUBSECTION (c) CONCERNING TEMPORARY SPECIAL USE PERMITS IN THE CPD, Cl-L, C-1 AND C-2 DISTRICTS WITHIN THE TRANSITION OVERLAY DISTRICT. BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that Section 26-209.2, Division 2, Article XVIII, Chapter 26 of the Code of the City of Fairfax, Virginia, is hereby amended by adding a new subsection (d) to read in its entirety as follows: Section 26-209.2. Permitted uses; by right and with special use permit. (d) Uses not permitted in the underlying zoning district may be permitted for up to three days with a temporary special use permit issued by City Council where the underlying zoning is CPD, Cl-L, C-1 or C-2 provided that: Such use is sponsored by a non-profit organiza- tion to stimulate revitalization or economic development within the district; Only one such permit per year is permitted per use; Ce Such use will generate no cost to the City for necessary public services such as, but not limited to, traffic management, crowd control or litter disposal, unless waived by City Council for good cause; de The applicant submits to the Zoning Administrator for review and approval a plan containing sufficient information, as determined by the Zoning Administrator, to verify compliance with the requirements for a temporary use permit and other applicable City Code regulations and policies to ensure the public health, safety and welfare. Such plan shall include the method and schedule of traffic management, crowd control and clean-up. ee Such plan is approved by the City Council. If deemed necessary by City Council, a bond may be required to ensure compliance with the plan. NOW, THEREFORE, BE IT FURTHER ORDAINED by the City Council of the City of Fairfax, Virginia, that Section 26-213.1, Article XIX, Chapter 26 of the Code of the City of Fairfax, Virginia be amended by adding a new subsection (c) to read in its entirety as follows: 1991-10 -2- Section 26-213.1. Uses Permitted. (c) Uses permitted by temporary special use permit in the Old Town Fairfax Historic District Regulations. The remaining subsections of the sections hereby amended shall remain in full force and effect. This ordinance shall become effective as provided by law.
