19910514 1991-12ORDINANCE NO. 1991- AN ORDINANCE DECLARING CERTAIN REAL ESTATE AT 4117 CHESTNUT STREET, DESIGNATED AS PART OF WILLIAMS ADDITION TO WESTMORE, TAX MAP PARCEL NUMBER 57- 1-((23))-65, TO BE SURPLUS AND AUTHORIZING THE SALE THEREOF. WHEREAS, the City of Fairfax, Virginia is the owner of a parcel of real estate, together with improvements thereon, designated as part of Williams Addition to Westmore, Tax Map Parcel Number 57-1-((23))-65 and located at 4117 Chestnut Street in the City of Fairfax (the "Real Estate"); and WHEREAS, by Resolution No. R-90-41, the City Council authorized the Director of Finance to obtain a written offer or offers to purchase the Real Estate; and WHEREAS, the Director of Finance received various offers, including an offer from Phillip W. Dutton, dated March 28, 1991, to purchase the Real Estate for the sum of $46,750.00 and has recommended that, if the City Council decides to declare the Real Estate to be surplus and to sell it, then this offer be accepted; and WHEREAS, the City has the authority to sell its real estate pursuant to Sections 15.1-307 and 15.1-847 of the Code of Virginia and Sections 2.3 and 5.9(f) of the City Charter; and WHEREAS, by this ordinance, the City Council declares the Real Estate to be surplus, accepts the offer from Phillip W. Dutton, dated March 28, 1991, in the sum of $46,750.00 to purchase the Real Estate, authorizes the Real Estate to be sold to Phillip W. Dutton, and authorizes that a deed therefor be executed by the City Manager on behalf of the City. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Fairfax that: 1991-12 1. A certain parcel of real estate, together with improvements thereon, owned by the City of Fairfax and designated as part of Williams Addition to Westmore, Tax Map Parcel Number 57-1-((23))-65 and located at 4117 Chestnut Street, is hereby declared to be surplus property because it is no longer needed for public uses. 2. On March 8, 1991, the City invited the public to submit written offers to purchase the Real Estate. Six offers were received. 3. The offer of Phillip W. Dutton, dated March 28, 1991, and attached hereto as Attachment A, to purchase the Real Estate for the sum of $46,750.00, is hereby accepted as being in the best interest of the City. 4. The City Council hereby authorizes the Real Estate to be sold to Phillip W. Dutton and authorizes the City Manager to execute a Special Warranty deed therefor and all other documents reasonably required in connection with such sale. 5. The sale of the Real Estate shall be made in accordance with the terms of the above-described offer, the request for offers dated March 8, 1991, City Council Resolution No. R-90-41, and the sale shall be subject to all liens, conditions, restrictions and easements of record which would be disclosed by a physical survey and inspection of the Real Estate. 6. The City Manager is further authorized to take all necessary actions, whether or not specifically described herein, to complete the conveyance of the Real Estate. 1991-12 This ordinance shall become effective as provided by law.
