AN ORDINANCE AMENDING CHAPTER 8 OF THE
CODE OF THE CITY OF FAIRFAX, VIRGINIA,
BY ADDING THERETO A NEW ARTICLE XIII
CONCERNING FEES TAXED AS COSTS IN
CRIMINAL AND TRAFFIC CASES IN THE
GENERAL DISTRICT COURT FOR THE CITY OF
FAIRFAX, VIRGINIA.
BE IT ORDAINED, by the City Council of the City of
Fairfax, Virginia that Chapter 8 of the Code of the City of
Fairfax, Virginia be and hereby is amended by adding a new
Article XIII thereto to read in its entirety as follows:
ARTICLE XIII. COURT FACILITIES FEES IN CRIMINAL
AND TRAFFIC CASES.
Section 8-78. Court facilities fees, imposition, amount.
In addition to any other fee or cost prescribed by law,
whenever fees are taxed as costs in a criminal or traffic
case in the General District Court of the City, there is
hereby assessed a fee of two dollars ($2.00) on each such
case in which the defendant is charged with a violation of
any statute or ordinance. Such fees shall be assessed and
collected as other fees are taxed in criminal or traffic
cases.
Section 8-79. Administration of court facilities fees.
The fees imposed pursuant to Section 8-78 shall be
charged and collected by the Clerk of the General District
Court for the City in the same manner as other fees are
charged and collected in such cases. The fees shall be
remitted by the Clerk to the City Treasurer and held by the
Treasurer subject to disbursement by the City Council for
the construction, renovation, or maintenance of courthouse
or jail and court-related facilities and to defray increases
in the cost of heating, cooling, electricity and ordinary
maintenance.

1, 1991.
