AN ORDINANCE AUTHORIZING THE CITY
MANAGER, ON BEHALF OF THE CITY OF
FAIRFAX, VIRGINIA, TO EXECUTE A DEED
AND ALL DOCUMENTS NECESSARY TO CONVEY
TO THE COMMONWEALTH OF VIRGINIA, THE
CITY'S INTEREST IN 0.0636 ACRES, MORE
OR LESS, OF REAL ESTATE LOCATED ON
THE EAST SIDE OF STATE ROUTE 123
(CHAIN BRIDGE ROAD) TOGETHER WITH A
PERMANENT EASEMENT FOR THE
CONSTRUCTION AND MAINTENANCE OF A
DRAINAGE FACILITY AND A TEMPORARY
CONSTRUCTION EASEMENT FOR STATE
HIGHWAY PROJECT 0123-151-104, RW201.
BE IT ORDAINED by the City Council of the City of
Fairfax, Virginia, that the City Manager is hereby
authorized to execute a deed (the "Deed"), approved as to
form by the City Attorney, necessary for the City of
Fairfax, Virginia (the "City") to convey to the
Commonwealth of Virginia (the "Commonwealth,,), for the
consideration of One Dollar ($1.00), the City's fee
simple interest in 0.063 acres, more or less, (the
"Property") of the 9.6845 acres of real estate owned by
the City and further described as Tax Map Parcel Numbers
57-4-((2))-13-A and 57-4-((2))-24, which Property is
needed by the Commonwealth for the widening of State
Route 123 (Chain Bridge Road) for State Highway Project
0123-151-01094, RW201. The Property is further described
as Parcel 007, as shown on sheets 4 and 5 of the plans
for existing Route 123, State Highway Project 0123,
151-104, RW201, prepared by David Volkert and Associates,
Inc. and revised by VDOT dated April 26, 1990 and most
currently revised on July 12, 1991 (the "Plans").
BE IT FURTHER ORDAINED that, by the Deed, the City
shall convey to the Commonwealth the permanent right and
easement to use additional areas shown on the Plans,
containing 0.020 acres, more or less, required by the
Commonwealth for the construction and maintenance of a

drainage facility, and the temporary right and easement
to use additional areas shown on the Plans, containing
0.122 acres, more or less, for the construction of cut
and/or fill slopes.
BE IT FURTHER ORDAINED that the City Manager is
authorized to execute all other documents as may be
necessary to convey the Property and the easements
described herein to the Commonwealth.
This ordinance shall become effective as provided by
law.
