19900109 1990-1ORDINANCE NO. 1990-1 AN ORDINANCE TO AMEND CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, TO INCORPORATE PROVISIONS FOR GUEST HOUSES AND REPEAL PROVISIONS FOR TOURIST HOMES, BOARDING AND LODGING HOUSES BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that the following is hereby incorporated into Section 26-4 of the Code of the City of Fairfax, Virginia: "Bed and Breakfast Inn - (also referred to as an inn) a structure in which eight (8) or less rooms are set aside for transient guests. Such rooms shall not have separate utilities, provisions for cooking or dormitories for sleeping and must be located within the principal structure." BE IT FURTHER ORDAINED that Section 26-159 of the Code of the City of Fairfax, Virginia, be amended to read in its entirety as follows: "Sec. 26-159. Permitted uses--by right. The following uses are permitted by right: Banks and offices for business and professional uses including medical, legal, insurance, real estate and similar offices. Inns shall also be permitted by right." BE IT STILL FURTHER ORDAINED that Section 26-166 of the Code of the City of Fairfax, Virginia, be amended by incorporating the following: "( 1 ) Inns." BE IT STILL FURTHER ORDAINED that the definition for "tourist homes" contained in Section 26-4 is hereby repealed. BE IT STILL FURTHER ORDAINED that Sections 26-110(n) and 26-114(n) are hereby repealed and reserved for future use. BE IT STILL FURTHER ORDAINED that Section 26-39.4(b) (1)d is hereby amended to read as follows: "(d) Rooming house: One (1) space for each sleeping room." BE IT STILL FURTHER ORDAINED that Section 26-39.4(b) (3) be amended by incorporating the following: "(q) Inn. One (1) space for each sleeping room, plus one (1) space for each employee on the major shift." This ordinance shall become effective as provided by law.
