19900626 1990-17ORDINANCE NO. 1990-17 AN ORDINANCE AUTHORIZING THE CITY MANAGER, ON BEHALF OF THE CITY OF FAIRFAX, VIRGINIA, TO EXECUTE ALL DOCUMENTS NECESSARY TO CONVEY TO PRINCE WILLIAM COUNTY, THE CITY'S INTEREST IN 36 ACRES, MORE OR LESS, OF REAL ESTATE LOCATED IN PRINCE WILLIAM COUNTY AND HELD IN TRUST BY THE BOARD OF THE NORTHERN VIRGINIA CRIMINAL JUSTICE ACADEMY FOR THE BENEFIT OF VARIOUS NORTHERN VIRGINIA JURISDICTIONS. BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that the City Manager is hereby authorized to execute all documents necessary for the City to convey to Prince William County, Virginia (the "County") the City's joint tenancy interest in approximately 36 acres, more or less, (the "Property") of the 139.50 acres of real estate held in trust by the Board of Northern Virginia Criminal Justice Academy for the benefit of the member jurisdictions of the Northern Virginia Criminal Justice Academy (the "Academy") which real estate is located near Nokesville, in Prince William County, Virginia and is described in a document entitled "Master Plan - Joint Training Center for the Northern Virginia Criminal Justice Academy and Prince William County," dated February 1990, and prepared by Dewberry and Davis, Architects, Engineers, Planners, and is further described on a plat entitled "Boundary Survey of the Property of Board of the Northern Virginia Criminal Justice Academy, Trustee, et al.," Man. BS-076, dated April 19, 1990, prepared by Dewberry and Davis, Engineers, Planners, Surveyors. 1990-17 -2 BE IT FURTHER ORDAINED that the City Manager is authorized to execute the documents only if the sale price of the Property is not less than the price per acre price which the Academy paid for the 139.50 acres of land which was conveyed by deed dated December 16, 1987 from Elizabeth K. Rodiger and Walter D. Rodiger to the Board of the Northern Virginia Criminal Justice Academy, as Trustee for the participating jurisdictions, which deed was recorded on December 22, 1987 in Deed Book 1534, Page 1268 among the land records of Prince William County, Virginia. BE IT FURTHER ORDAINED that the City Manager is authorized to execute all documents for such conveyance only after the Academy and the County have entered into a site development agreement and after each of the jUrisdictions owning an interest in the Property have agreed by ordinance, resolution or other lawful and legally binding act, to convey their respective interests in the Property to the County.
