AN ORDINANCE TO AMEND SECTION 26-4 (DEFINITIONS) AND
ARTICLE II, DIVISION 7 (SIGNS) OF CHAPTER 26 OF THE CODE
OF THE CITY OF FAIRFAX, VIRGINIA, TO INCORPORATE ADDITIONAL
PROVISIONS FOR FLAGS.
BE IT ORDAINED by the City Council of the City of Fairfax,
Virginia, that Section 26-4 of the City Code is hereby amended
to incorporate the following definitions:
"Banner: A sign which consists of a light-weight, flexible
material, which is supported an(! fixed by a frame, ropes,
cables, wires or other anchoring device on a minimum of two
sides, whose movement is constrairled."
"Flag. A piece of light-weight, flexible material, which is
attached to a frame, rope, cable, w!ire, staff or other anchoring
device and has some freedom of movement."
BE IT FURTHER ORDAINED that Article II, Division 7 (Signs),
Table III (Old and Historic District Bulk Regulations for Signs)
of the Code of the City of Fairfax, Virginia, is hereby amended
to incorporate the following row describing permitted flags:

BE IT FURTHER ORDAINED that A~ticle II, Division 7 (Signs),
Section 26-46(c) be amended to read in its entirety as follows:
"(c) Moving signs or devices interided to attract attention, all
or any part of which is intendedi to move, including but not
limited to flags (including pennants), balloons, propellers and
discs except as provided for in Sections 26-44(b)(4) and 26-
48.1(d)."
This ordinance shall become effective as provided by law.
