AN ORDINANCE TO AMEND AND REORDAIN THE ZONING
ORDINANCE OF THE CITY OF FAIRFAX BY AMENDING
THE ZONING MAP TO RECLASSIFY FROM C-2 RETAIL
COMMERCIAL TO C-3(p) GENERAL COMMERCIAL WITH
PROFFERS PROPERTY IDENTIFIED AS CITY OF FAIRFAX
TAX MAP PARCEL 57-1-((2))-35. (TEXACO, STAR
ENTERPRISES)
WHEREAS, the applicant has requested a change in the zoning
classification from C-2 to C-3(p) for the parcel described above
and more specifically described as follows:
Beginning at an iron pipe found in a northerly line of Lee
Highway, Route 29 (variable width), said iron pipe being a corner
between Jackson Associates (now or formerly) and the land
hereindescribed; thence from the point of beginning and running
with said northerly line of Lee Highway S88°13'00"W 185.82 feet to
an iron pipe found at a corner to Chesapeake Bay Seafood House
Associates (now or formerly); thence departing said northerly line
of Lee Highway and running with the dividing line between
Chesapeake Bay Seafood House Associates (now or formerly) and the
land hereindescribed Nll°29'00"E 261.76 feet to an iron pipe found
and S84° 21'50"E 157.63 to another iron pipe found lying in a
westerly line of aforesaid Jackson Associates (now or formerly);
thence running with the dividing line between Jackson Associates
(now or formerly) and the land hereindescribed S05°38'40"W 236.40
feet to the point and place of beginning, containing 0.9711 acres
(42,301 sq. ft.) of land, more or less; and
WHEREAS, the City Council has carefully considered the
application, the recommendation of the Planning Commission and
Staff, and the testimony received at public hearing; and
WHEREAS, the City Council has determined that the proposed
rezoning is proper and in accordance with the pertinent provisions
set forth in the Code of Virginia and the Code of the City of
Fairfax:
NOW, THEREFORE, BE IT ORDAINED that the above described
property be rezoned from C-2 Retail Commercial to C-3(p) General
Commercial with the proffers attached hereto and made part hereof.
This Ordinance shall take effect as provided by law.
