AN ORDINANCE TO REPEAL SECTION 26-36, ARTICLE
II, CHAPTER 26ANDAMEND SECTION 26-172(a)(10),
ARTICLE XIII, CHAPTER 26 OF THE CODE OF THE
CITY OF FAIRFAX, VIRGINIA, PERTAINING TO THE
ENLARGEMENT, EXTENSION, RECONSTRUCTION OR
ALTERATION OF CERTAIN NONCONFORMING USES IN THE
C-2 DISTRICT.
BE IT ORDAINED by the City Council of the City of Fairfax,
Virginia, that Section 26-36, Article II, Chapter 26 of the Code
of the City of Fairfax, Virginia, is hereby repealed and reserved
for future use.
BE IT FURTHER ORDAINED that Section 26-172(a)(10) of the Code
of the City of Fairfax, Virginia, be amended to read in its
entirety as follows:
"The enlargement, extension, reconstruction or structural
alteration of a nonconforming use in the C-2 district may be
authorized by special use permit issued by city council in
accordance with the provisions of Section 26-103; provided that any
new construction or extension of existing improvements shall
conform to the requirements contained in Section 26-173, except to
the extent that those requirements are modified by special
exception. Each application for a special use permit to which this
subsection applies shall be accompanied by a conceptual development
plan containing the information specified in Section 26-177(a)(4)i,
unless waived by the zoning administrator."
This ordinance shall be effective as provided by law.
