AN ORDINANCE AMENDING SECTION 26-4
OF THE CODE OF THE CITY OF FAIRFAX,
VIRGINIA.
BE IT ORDAINED by the City Council of the city of Fairfax,
Virginia, that the following definitions are hereby incorporated
into Section 26-4 of the city Code:
,,Director: The Director of the Department of Community Development
and Planning.
Dripline: An imaginary line on the ground beneath a tree which
delineates the extent of the tree's canopy.
Structure: A combination of materials to form a construction for
use, occupancy or ornamentation whether installed on, above or
below the surface of the ground.
Structure, main: a structure which contains a primary or
predominant use.
Tree, Desiqnated Specimen: Any tree which the city Council has
designated by ordinance to be notable by virtue of its outstanding
size and quality for its particular species.
Tree, Heritaqe: Any tree which the City Council has designated by
ordinance to have notable historic or cultural interest.
Tree, Memorial: Any tree which the City Council has designated by
ordinance to be a special commemorating memorial.
Tree, Street: Any tree which grows in the right-of-way of a street
or on private property adjacent to a street as authorized by the
owner and placed or planted there by the city and designated by
ordinance.
Tree: Any living, self-supporting woody plant which produces one
main trunk and is ten (10) feet or greater in height, and three and
one-half (3 1/2) inches or greater in caliper measured six (6)
inches above ground level.
Tree Canopy: The horizontal spread of a tree."
BE IT FURTHER ORDAINED that the definition of "person"
contained in Section 26-4 of the City Code is hereby amended to
read in its entirety as follows:
"Person: Any individual, public or private entity, corporation,
partnership, association, government authority or other legal
entity."
