AN ORDINANCE AMENDING FAIRFAX CITY CODE SECTION 5.1-29(a)
TO INCREASE THE CABLE TELEVISION FRANCHISE FEE
TO THE FRANCHISEE FROM THREE PERCENT TO FIVE PERCENT
BE IT ORDAINED by the City Coundl of the City of Fairfax, Virginia, that
Section 5.1-29(a) of the Code of the City of Falrfax, Virginia, be and hereby is
amended to read in its entirety as follows:
1. Section 5.1-29(a) shall be amended to read in its entirety as follows:
(a) A grantee, in consideration of the privilege granted under a franchise
to operate a cable television system shall build a cable television system in
accordance with the terms and conditions of this chapter and the franchise and shall
pay a franchise fee to the dry during the period of operation under the franchise.
The franchise fee shall be five (5) percent of the grantee's gross revenues which shall
be payable within thirty (30) days of the grantee's filing the finandal statement with
the City as spedfied in subsection (b) below we m~e tha~ ~he maximum ameunt
pe~mitqed u~de~ lede, a4 ~ sta~e taw. A grantee shall, at all times, have the duty to
take forthwith all steps necessary and proper to relieve itself and the dry from any
limitations which may exist under law with regard to franchise fee limitations.
This ordinance shall become effective July 1, 1988.
