19880628 1988-14 ORDINANCE NO. 1988-14 AN ORDINANCE AMENDING THE DEFINITION OF MINOR HOME OCCUPATIONS IN CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that Section 26-4 of the Code of the City of Fairfax, Virginia, be and hereby is amended to include the definition of "automobile repair garage" to read in its entirety as follows: "Motor vehicle repair establishment: An area of land including any struct- ure thereon used for the repair or maintenance of motor vehicles as a commer- cial business. An area of land or structure used for the occasional, incidental repair or maintenance of a motor vehicle registered to the resident for personal use shall not be deemed a motor vehicle repair establishment." BE IT FURTHER ORDAINED that the definition of "minor home occupations," also in Section 26-4 of the Code of the City of Fairfax, Virginia, be and hereby is amended to read in its entirety as follows: "Minor home occupation: The use of offices, studios, or occupational rooms located within a single family dwelling unit for business or commercial purposes by a person for whom the dwelling unit is the primary residence and in which he or she does actually reside during non-business hours. Minor home occupations are subject to the following restrictions: (a) No person other than a member of the family residing on the prem- ises shall be engaged in the occupation; (b) There shall be no visible evidence (including signs of any size) of the minor home occupation in the outside appearance of the premises; (c) The minor home occupation shall generate no greater volume of traffic than would normally be expected from a single family residence; (d) The business or commercial use shall not generate any need for parking spaces; and (e) No equipment shall be used other than that normally used for dom- estic or household purposes in a single family residence. Any of the occupations listed under the definition of "major home occupa- tion'' may qualify as a minor home occupation provided that the proposed use meets the criteria listed above. The term "minor horhe occupation" shall not include any funeral home, kennel, veterinarian office, animal hospital, nursery school, motor vehicle repair establishment, or establishment in which goods are offered for sale." BE IT STILL FURTHER ORDAINED that Section 26-188(j) of the Code of the City of Fairfax, Virginia, be and hereby is amended to read in its entirety as fol- lows: "Motor vehicle repair establishment~., including body and fender repair, truck repair and overhaul, motorcycle repair;" This ordinance shall become effective immediately upon its execution by the Mayor. 1988-14 -2- Plannin§ Commission hearing: June 13, City Council hearing: June 28. 1988 Adopted: June 28, 1988 1988 ATTEST: - ~iJty C~l~rk
