AN ORDINANCE AMENDING SECTION 5-2,
ARTICLE I OF CHAPTER 5 OF THE CODE OF THE
CITY OF FAIRFAX, VIRGINIA, AND ARTICLE
III OF CHAPTER 5 OF THE CODE OF THE CITY
OF FAIRFAX, VIRGINIA, PERTAINING TO
CERTAIN REQUIREMENTS OF THE HOME
IMPROVEMENT CODE.
BE IT ORDAINED, by the City Council of the City of
Fairfax, Virginia that the Section 5-2, Article I of Chapter
5 of the Code of the City of Fairfax, Virginia, be and hereby
is amended by the deletion in its entirety of subsection (10)
thereof defining #Home improvement contract.#
BE IT FURTHER ORDAINED, by the City Council of the City
of Fairfax, Virginia that Article III of Chapter 5 of the
Code of the City of Fairfax, Virginia, be and hereby is
amended by the deletion in their entirety of Sections 5-12
and 5-13 thereof.
BE IT STILL FURTHER ORDAINED, that the Section 5-18 of
Article III of Chapter 5 of the Code of the City of Fairfax
be and hereby is amended to read in its entirety as follows:
~ection 5-18. Use of article as defense.
No person shall be entitled to assert this
article as a defense to any action at law or suit
in equity unless such person shall first
affirmatively prove that notice of this article
prior to and upon execution of the contract for
home improvement work has been given to the party
who seeks to recover from such person. (Ord. No.
1975-11, 3-18-75, Sec. 5-26.)
This ordinance shall be effective upon its execution by
the Mayor.
