AN ORDINANCE AMENDING FAIRFAX CITY CODE SECTION 26-39.2E(7)
PERTAINING TO THE WAIVER OF LANDSCAPING AND SETBACK
REQUIREMENTS FOR PARKING AREAS
BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that the
Falrfax City Code Section 26-39.2E(7) be amended to read in its entirety as follows:.
"Where City Council grants a special exception modifying the requirements of
this subsection, the special exception shall be deemed also to constitute a waiver of
minimum yard and landscaping requirements specified elsewhere in this Chapter;
otherwise, where provisions of this Chapter dictate landscaping or special require-
ments different from those set forth in this subsection, the more stringent require-
merits shall prevail."
This ordinance shall be effective immediately upon its execution by the Mayor.
