19860325 1986-16ORDINANCE NO. 1986-16 AN ORDINANCE AMENDING SECTION 14-10 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA TO ESTABLISH THE OFFENSE OF UNLAWFUL ASSEMBLY. BE IT ORDAINED by the City Council of the City of Fairfax, ;irginia that Section 14-10 of the Code of the City of Fairfax, Virginia be and hereby is amended to read in its entirety as follows: "Section 14-10. Unlawful Assembly. (a) Every person who participates in an unlawful assembly shall be guilty of a class 1 misdemeanor. (b) Every person, except the owner or lessee of the premises, his family and nonrioting guests, and public officers and persons assisting them, remaining present at the place of an unlawful assembly after having been lawfully warned to disperse, shall be guilty of a class 3 misdemeanor. (c) An "unlawful assembly" occurs whenever three (3) or more persons assembled share the common intent to advance some lawful or unlawful purpose by the commission of an act or acts of unlawful force or violence likely to jeopardize seriously public safety, peace or order, and the assembly actually tends to inspire persons of ordinary courage with well-grounded fear of serious and immediate breaches of public safety, peace or order."
