19850423 1985-9ORDINANCE NO. 1985-9 This Ordinance was adopted by Council on April 23, 1985, but was never signed by the Mayor. It was inserted in this file on November 1, 1990. 1985-9 -2 The final site plan shall generally conform to the Illustrative Site Plan. Construction of road widening and required sidewalk and curb for Route 123 along the frontage of the property will be in accordance with Fairfax~City standards and Virginia Department of Highways and Transportation and as approved by the Director of Public Works. A 6' high brick wall shall be constructed along the eastern and southern borders that abut existing single family developments in lieu of the stockade fence, subject to waiver approval from the Board of Zoning Appeals. The existing mature trees located on the property lines will be protected by providing sufficient setback for these walls from the drip-line of the trees. The left turn to and from Route 123 at the new entrance shall be used only as permitted by the Director of Public Works. The applicants agree that neither they nor their agents shall apply to the Board of Zoning Appeals or other public authority for variances or waivers from these proffers. These conditions shall apply to the subject property as if the same were a part of the regulations provided for the Cl-L Zoning District and any person violating such conditions shall be punished as provided in Section 26-7 of the Zoning Ordinance. BE IT STILL FURTHER ORDAINED that the Zoning Administrator of the City is directed to amend the Zoning Map to show the change in the zoning of these premises, including the existence of the conditions, and that the Clerk of this Council is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator, and to the Planning Commission of this City as soon as possible. This ordinance shall take effect immediately upon its passage by the City Council of the City of Fairfax, Virginia. Adopted: April 23, 1985 Mayor ATTEST: City Clerk
