AN ORDINANCE A MENDING SECTIONS 26-4, 26-165.1(a)(1), 26-170.1(a)(3),
AND 26-175.1(a)(2) OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA
BE IT ORDAINED by the City Council for the City of Fairfax, Virginia, that
Sections 26-4, 26-165.1(a)(1), 26-170.1(a)(3) and 26-175.1(a)(2) of the Code of the City of
Fairfax, Virginia, be and the same are hereby amended as follows:
1. Section 26-4 is amended by repealing the definition of "Dancing Area" and
enacting a new definition of "Dancing Area" to read in its entirety as follows:
"Dancing Area. An area for dancing, operated as an ancillary use to a
restaurant, which area (including any area used to provide music for such
dancing) shall not be more than twenty-five (25) percent of the gross floor area
of the restaurant."
2. Section 26-165.1(a)(1) is amended by adding a subparagraph, Section
26-165.1(a)(l)b, to read as follows:
"b. Unless waived by the City Council, no dancing area shall be less than
400 square feet in area."
3. Section 26-170.1(a)(3) is hereby amended by adding a subparagraph, Section
26-170.1(a)(3)b, to read as follows:
"b. Unless waived by the City Council, no dancing area shall be less than
400 square feet in area."
4. Section 26-175(a)(2) is hereby amended by adding a subparagraph, Section
26-175.1(a)(2)b, to read as follows:
"b. Unless waived by the City Council, no dancing area shall be less than
400 square feet in area."
This ordinance shall become effective immediately upon its execution by the
Mayor.
