AN ORDINANCE AUTHORIZING THAT THE FAIRFAX ELEMENTARY
SCHOOL PROPERTY (TAX MAP NO, 57-~-2-138) BE ADVERTISED
AND SOLD WITH CERTAIN CONDITIONS
WHEREAS, after public hearing and comment, it has been determined by the
City Council of the City of Fairfax that certain real property and the improvement
thereon known as the Fairfax Elementary School are surplus and should be disposed
of in accordance with law, and
WHEREAS, Article VII, Section 9 of the Constitution of Virginia and Section
15.1-307 of the Code of Virginia (1950), as amended, require that an ordinance be
passed by a recorded affirmative vote of three-quarters of all members elected to
Council, and
WHEREAS, the Code of the City of Fairfax, Virginia, Section 18.1-23, requires
for the sale of City property the use of "competitive bids whereever feasible to
obtain the highest price," and
WHEREAS, the City Council deems it to be in the best interests of the City of
Fairfax and it citizens to provide for the acquisition, restoration, and preservation of
historic sites and buildings within the City,
BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that the
Fairfax Elementary School property specifically 1.981 acres containing the School
Building of 33,625 square feet, Tax Map No. 57~4-2-138~ shall be sold to the highest
and best bidder and that up to fifty percent of the proceeds, but not in excess of
$300,000.00, shall be reserved and used exclusively for the acquisition, restoration,
and preservation of historic sites and buildings in the City of Fairfax, and up to
$75,000 shall be reserved for the additional funding required of the Westmore
Elementary School project.
The city manager is hereby authorized and directed to request and receive bids
for the property, once the necessary steps are taken to rezone the property from
residential to commercial, with the following conditions:

All bidders be requested to submit, with the proposed purchase price, a
description of the intended use of the property.

The minimum purchase price shall be specified in the invitation to bid and
shall be established by the City Council after completion of the rezoning
process.
The Council reserves the right to reject any and all bids and not to sell
the Fairfax Elementary School property.
After the bids have been received and evaluated by staff, the city manager is
directed to present such bids to City Council for selection of the highest and best
bidder.
The vote of individual Council members shall be recorded below and this ordi-
nance shall be effective immediately upon passage by three-quarters of Council and
its execution by the mayor.
