19840911 1984-10ORDINANCE NO. 1984-10 AN ORDINANCE AMENDING THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, SECTION 26-25(a), WHICH DEALS WITH SITE AGREEMENTS AND BONDS BE IT ORDAINED by the City Council with the City of Fairfax, Virginia, that Section 26-25(a) of the Code of the City of Fairfax, Virginia, be and hereby is amended to read in its entirety as follows: Sec. 26-25. Completion Agreement and Bond (a) Prior to approval of any site plan, there shall be executed by the owner or developer and submitted with the site plan an agreement in form and substance as approved by the city to construct all physical improve- ments required by the provisions of this chapter together with a bond with surety or condition accept- able to the city in the amount of the estimated cost of the required physical improvements as determined by the director of public works. The aforesaid agreement and bond shall be provided to ensure completion of all work or improvements therein stated within the time cited in the agreement and determined by the director of public works. The completion time may be extended by the city manager upon written application by the owner or developer, signed by all parties to the original agree- ment and to the bond. No extension shall be issued without the express consent of the surety on the bond. The adequacy, conditions and acceptability of any bond hereunder shall be determined by the bond committee. In any case where the bond committee has rejected any such agreement or bond, the owner or developer may appeal from such decision to the city council, provided the owner or developer has paid to the city the requir- ed filing fee. This ordinance shall be effective immediately upon its being signed by the Mayor. INTRODUCED: ADOPTED: ATTEST: September 11, 1984
