AN ORDINANCE AMENDING SECTION 17-10(i) OF THE CODE OF THE
CITY OF FAIRFAX, VIRGINIA, PERTAINING TO PERSONNEL
BE IT ORDAINED by the City Council of the City of Fairfax,
Virginia, that Section 17-10(i) of the Code of the City of
Fairfax, Virginia, be and the same is hereby amended as follows:
Section 17-10(i) is amended by adding the following new
material immediately before the last sentence thereof:
Commencing on January 1, 1985, the contributions described
in (1) above will be picked up by the City and treated as
employer contributions pursuant to section 414(h) of the
Internal Revenue Code, but each employee's salary shall be
reduced by the amount of the contributions picked up on
his or her behalf. No employee shall have any option to
receive such contributions directly instead of having
them contributed to the applicable retirement plan describ-
ed in (1) above. For all purposes other than income tax
purposes, including but not limited to retirement plans,
other employee benefits and Social Security, each employee's
salary will be deemed to include without duplication the
contributions picked up pursuant to the preceding sentence.
Contributions so picked up on behalf of an employee shall
be paid from the same source of funds as is used in paying
the employee's wages.
This ordinance shall become effective immediately upon its
execution by the Mayor.
