AN ORDINANCE AMENDING SECTION 18-5 OF THE CODE
OF THE CITY OF FAIRFAX, VIRGINIA.
BE IT ORDAINED by the City Council for the City of
Fairfax, Virginia that Section 18-5 of the Code of the City of
Fairfax, Virginia be and the same is hereby amended to read in
its entirety as follows:
"Sec. 18-5. Escape from custod~o_r_~a_~i~l_.
(a) If any person lawfully imprisoned in jail
and not tried yet or sentenced on a criminal offense
escapes from jail by force or violence, other than by
setting fire thereto, or if any person lawfully in
the custody of any police officer on a charge of a
criminal offense escapes from such custody by force
or violence, such person shal 1 be additional ly
confined in jail not exceeding twelve months.
(b) If any person lawfully imprisoned in jail
or lawfully in the custody of any court or officer
thereof, or of any law-enforcement officer on a
charge or after a conviction of a criminal offense,
escapes, other than by force or violence or by
setting fire to the jail, such person shall be guilty
of a class 2 misdemeanor."
This ordinance shall become effective immediately upon its
execution by the Mayor.
