19821123 1982-41ORDINANCE NO. 1982-41 AN ORDINANCE ADDING A NEW SECTION 4-20 TO ARTICLE III OF CHAPTER 4 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA. BE IT RESOLVED that the City Council of the City of Fairfax, Virginia, finding that an emergency exists, hereby enacts an emergency ordinance pursuant to the authority granted by Section 29-213.21 of the 1950 Code of Virginia, as amended, to be numbered 4-20, and to read in its entirety as follows: Sec. 4-20. Emergency measures. (a) It is hereby determined that there is sufficient reason to believe that a rabid animal or animals are at large in the city, and that an emergency exists requiring immediate measures to prevent the spread of the disease of rabies. (b) The owners of all dogs in the city shall keep the same confined on their premises unless such dogs are leashed under restaint of the owner in such a manner that persons or animals will not be subject to the danger of being bitten thereby. The provisions of subsection (b) shall be operative for a period not to exceed thirty (30) days unless renewed by the city council. (c) It shall be unlawful to permit the running at large, within the city, of dogs which have not been inoculated or vaccinated against rabies. (d) Dogs showing act ive signs of r abi es o r suspected of having rabies shall be surrendered to one of the persons charged with the enforcement of this article for impoundment or observation as under section 4-15, for such time as may be necessary to determine a diagnosis. If confinement is impossible or impracticable, such dog shall be destroyed. (e) Every person having knowledge of the existence of an animal apparently afflicted with rabies shal 1 report immediately to the health department the existence of such animal, the place where seen, the owner's name, if known, and the symptoms suggesting rabies. (f) Every person who shall be in violation of this section shall be guilty of a Class 4 misdemeanor and, upon conviction thereof, be punished as provided in section 1-6(a)(4). (g) This section shal 1 pass only upon two-thirds affirmative vote of the members of the city council present. This ordinance shall be effective immediately upon its execution by the Mayor.
