19810929 1981-16ORDINANCE NO. 1981-16 AN EMERGENCY ORDINANCE ~4ENDING ARTICLE V'of CHAPTER 8 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA BE IT ORDAINED by the City Council of the City of Fairfax, Virginia that Article V of Chapter 8 of the Code of the City of Fairfax, Virginia be and the same is hereby amended as follows: 1. That a new Section 8-20.1 of said Article be and it is hereby enacted to read in its entirety as follows: "Sec. 8-20.1 Exemption of certain energy sources. Sales of artificial or propane gas, firewood, coal or home heating oil used for domestic consumption as defined in section 58-441.6(gl) of the Code of Virginia, as amended, are hereby exempt from the general retail sales tax at the rate of one percent levied by section 8-20 of this article. 2. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance should be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this ordinance, which shall remain in full force and effect; to this end the provisions of this ordinance are hereby declared to be severable. In the opinion of the city council of the City of Fairfax, Virginia, an emergency exists due to the effective date of section 58-441.6(gl) and section 58-441.49:3 of the Code of Virginia, as amended, which requires immediate action. Accordingly, this ordinance adopted by a two thirds affirmative vote of the city council shall become effective immediately.
