AN ORDINANCE ~ENDING SECTION 12-13
AND 12-14 OF T!~E CODE OF THE CITY OF
FAIRFAX, VIRGINIA, A~TD REPEALING SECTION 12-37
OF THE C~DE OF THE CITY OF FAIRFAX, VIRGINIA.
BE IT ORDAINED by the City Council of the City of Fairfax,
Virginia, that Section 12-13 and 12-14 of the Code of the City of
Fairfax, Virginia, be amended as herein provided and that Section
12-37 of the Code of the City of Fairfax, Virginia, be repealed
in its entirety.
1. Section 12-13 of the Code of the City of Eairfax,
Virginia, is amended and re-enacted to read in its entirety as
follows:
"Sec. 12-13. Proration of license taxes not permitted unless
specifi'cally provided.
There shall be no proration of license taxes under this
chapter unless there is a specific ~rovision herein allowin~ such
proration."
2. Section 12-14 of the Code of the City of Eairfax,
Virginia, is amended and re-enacted to read in its entirety as
follows:
"Sec. 12-14. Transfer of license taxes.
License taxes which have been paid in full are transferable
to the assignee or successors in interest of any licensee except
where otherwise provided and except for those licenses which are
issued in accordance with Sections 12-27 through 12-39. Such
license taxes are not refundable under any circumstances. If the
license tax already paid by the assignor is less than the license
tax which is assessable against the assignee under this chapter
but for the assignment, an additional license tax shall be paid
by the assignee equal to the difference between the tax paid on
the assigned license and the license tax which is otherwise
assessable against the assignee."
3. Section 12-37 of the Code of the City of Fairfax,
Virginia, be and the same is hereby repealed in its entirety as
follows:
1980-25
"Sec. 12-37. REPEALED.
Reserved."
This ordinance shall become effective immediately upon
adoption.
