19790918 1979-16aORDINANCE NO. 1979-16A AN ORDINANCE TO REZONE FROM R-2 TO PD 12.2OO3 ACRES OF LAND MORE OR LESS, LOCATED IN THE 3800 BLOCK OF CHAIN BRIDGE ROAD AND SHOWN ON CITY TAX MAP AS 57-2-((2))-147, 158 and 159, AND TO ACCORDINGLY CORRECT THE ZONING MAP OF THE CITY OF FAIRFAX, VIRGINIA (APPLICATION NO. Z-637- 79-I). WHEREAS, Robinson & Thayer, Incorporated, contract-owner, has heretofore iled with this Council a written application to have rezoned from R-2 to PD 2.2003 acres of land more or less, located in the 3800 block of Chain Bridge , and shown on City tax map as 57-2-((2))-147, 158 and 159, and more ~articularly described as follows: Beginning at an iron pipe set in a southwesterly line of Chain Bridge Road, State Route #123, 25' from centerline, said pipe being a corner between~Prichard and the land hereindescribed; thence from the point of beginning, departing said southwesterly line of Chain Bridge Road and running with the dividing line between Prichard and the land here- indescribed S22o55'34"W and the same course continued with the dividing line between McCandlish and the land hereindescribed, a total distance of 523.00 feet to an iron pipe found, said iron pipe being a corner between McCandlish and VanDyck; thence running with the dividing line between VanDyck and the land hereindescribed S22°42'18"W 124.57 feet to an iron pipe set at the northeast corner to Trustees, Truro Episcopal Church; thence running with the dividing line between Trustees, Truro Episcopal Church and the land herein- described N66o26'45"W 282.05 feet to an iron pipe found in an easterly line of Mosby Apt. Assoc; thence running with the dividing line between Mosby Apt. Assoc. and the land hereindescribed N29°56'50"E 236.01 feet to an iron pipe found, said pipe being a corner to Rust; thence running with the dividing line between Rust and the land hereindescribed N29°56'50"E 175.00 feet and N22ooo'oo"E 327.13 feet to a point on a curve lying in a southwesterly line of aforesaid Chain Bridge Road, 25' from centerline; thence running with a curve to the left of radius 180.O0 feet (having chord of l!3.40 feet, bearing S35o52'45"E) an arc length of 115.37 feet to an iron pipe set at a point of tangency 25' from centerline; thence running S54°14'26'1E 143.17 feet to the point and place of beginning, contain- ing 3.8482 acres of land, more or less, and Beginning at an iron pipe set in a westerly line of Chain Bridge Road, State Route 123, 25' from centerline, said pipe being a corner between Taba and the land hereindescribed; thence from the point of beginning and running with said westerly line of Chain Bridge Road SilOl6'46"W 90.29 feet to an iron pipe set at a point of curvature 25' from center- line; thence running with a curve to the left of radius 180.00 feet (having chord of 89.52 feet, bearing S03o07'09"E) an arc length of 90.7 feet to a point of a curve 25' from centerline, said point being a corner to Patteson; thence departing said westerly line of Chain Bridge Road and running with the dividing line between Patteson and 1979-16A the land hereindescribed S22°O0'00"W 327.13 feet and S29°55'50"W 175.00 feet to an iron pipe found, said pipe being a corner to Mosby Apt. Assoc.; thence running with the dividing line between Mosby Apt. Assoc. and the land hereindescribed N6OO23'20"W and the same course continued with the dividing line between Howze, et al, and the land hereindescribed, and the same course continued with the dividing llne betwen Kielsgard, et al, and the land hereindescribed, a total distance of 605.55 feet to an iron pipe set in an easterly line of Railroad Avenue (30' wide); thence running with said easterly line of Railroad Avenue, passing over the northerly terminus thereof at 77.62 feet and continuing with the dividing line between Adkerson and the land hereindescribed and thence with the dividing line be- tween Briarcliff Subdivision and the land hereindescribed, along the arc of a curve to the left of radius 925.40 feet (having chord of 573.43 feet, bearing N22°OS'58"E) an arc length of 583.03 feet to an iron pipe found in an easterly line of Lot 18, Briarcliff Subdivision at the southwest corner to Nelson; thence running with the dividing line between Nelson and the land hereindescribed S69°40'14"E and the same course continued with the dividing llne between Taba and the land hereindescribed, a total distance of 568.86 feet to the point and place of beginning, containing 8.3521 acres of land, more or less. WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required general development plan and pre- iminary site plan and the receipt showing payment of the fee required to be ,aid at the time of the filing thereof, was promptly referred to the Planning :ommission of this City for its investigation and recommendations thereon, and was duly advertised for public hearing before the Planning Commission in the ~anner and for the time required by the Zoning Ordinance of this City, as amend- ed, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and ~as heard by the Planning Commission in public hearing pursuant to such adver- tisement, and was duly advertised for public hearing thereon before this Council n the manner and for the time required by the Zoning Ordinance of this City, ,s amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, ,nd WHEREAS, said public hearing on said application has been this day held, ~nd said Council has considered the recommendations of said City Planning Commission, duly filed, and the evidence presented in connection with said application at the public hearing, and has reached its decision on said appli- cation and preliminary site plan; NOW THEREFORE, BE IT ORDAINED that said application be and the same here- by is granted and that the aforesaid land hereinbefore and in said application -2- 1979-16A more specifically described be and it hereby is rezoned from R-2 to PD as set forth and defined in the said Zoning Ordinance and amendments thereto, subject to the use regulations permitted in such PD zone, and the site plan is approve( with variances as follows: A. Except as shown on the site plan, the construction of curb, gutter and sidewalks on Route 123 will not be required. B. That the sight triangles required by Paragraph G. lO of the PD Ordinance shall be forty-five feet instead of fifty feet. C. The subdivision streets shall be constructed as shown on the site plan with a pavement of twenty-two feet. D. The intrusion of the gazebo into the flood plain, as shown on the site plan, is allowed subject to review and approval by the Director of Public Works. E.Waiving of the requirement for commercial floor space as called for in the PD Ordinance. and the Zoning Administrator of the City hereby is directed to correct the Zoning Map heretofore adopted as a part of the Zoning Ordinance to properly show such change in the zoning of said land, and the Clerk of this Council be and she now hereby is directed to transmit duly certified copies of this ordinance to the applicant, the Zoning Administrator and the Planning Commission of this City as soon as possible.
