AN ORDINANCE ~ENDING SECTION 2-47.1 (e)
OF CHAPTER 2, ARTICLE VIII OF THE CODE
OF THE CITY OF FAIRFAX, VIRGINIA,
TO ADD SUBSECTIONS (2) AND (3).
BE IT ORDAINED by the City Council of the City of Fairfax,
Virginia, that Article VIII of Chapter 2 of the Code of the
City of Fairfax, Virginia, be and it hereby is amended in the
following manner:
1. That section 2-47.1 (e) of the said Article be and
is hereby amended by adding subsections (2) and (3) as follows:
"(2) The hearing shall be conducted by a panel,
comprised of one member from within the department selected by
the officer, one member appointed by the Chief of Police from
within the department of equal rank of the officer but no more
than two ranks above the officer, and a third member from within
the department to be selected by the other two members of the
panel. In the event the two members cannot agree upon their
selection of a third member for the panel, the Chief Judge of
the Circuit Court of the Judicial Circuit shall choose such
third member.
(3) The recommendations of the panel, and the
reasons therefor, shall be in writing and shall be transmitted
promptly to the officer and to the chief of police. Such
recommendations shall be advisory only, but shall be accorded
significant weight."
This amendment shall become effective immediately upon its
adoption by the City Council of Fairfax City, Virginia.
