19780110 1978-1ORDINANCE NO. 1978-1 AN ORDINANCE AMENDING AND REENACTING SECTION 7(H) (2) OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA, RELATING TO THE REMOVAL, COSTS AND CHARGES FOR SIGNS ERECTED IN VIOLA- TION OF THE ZONING ORDINANCE. BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that Section 7(H)(2) of the Zoning Ordinance of the City of Fairfax, Virginia, be, and it hereby is, amended and reenacted to read in its entirety as follows: "H. PROCEDURE AND FEES FOR SIGN PERMITS "2. Any sign which is erected, used, maintained, operated, posted or displayed in violation of Section 7 of the Zoning Ordinance is hereby declared to be a public and private nuisance, and is subject to immediate removal by the Zoning Administrator or his agent, or by any member of the City Police Department. The City may collect the cost of such removal, obliteration or abatement from the person concerned. In addition to any penalty which may be incurred for violation of this Section and in addition to any other costs or fees which may be collected pursuant to this Section, the following charges shall be paid by the person concerned prior to the return of any sign removed pursuant to this Section 7 Subsection (H)(2): (a) Five dollars ($5.00) for each sign held for ten days or less. (b) Ten dollars ($10.00) for each sign held for more than ten days. Signs constructed of cardboard or paper shall be destroyed upon removal. Ail other signs shall be held for 30 days and thereafter shall be deemed to be abandoned and forfeited and may be destroyed. This ordinance shall become effective immediately upon its adoption.
