AN ORDINANCE AMENDING AND REENACTING SECTION 3.07
OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX,
VIRGINIA RELATING TO TOWERS.
BE IT ORDAINED by th.e~ City Council of the City of Fairfax, Virginia,
that Section 3.07 of the Zoning Ordinance of the City of Fairfax, Virginia,
be and it hereby is amended and reenacted to read in its entirety as
follows:
"3.07 Church spires and similar integral towers not used for human
habitation, excluding signs, may extend above the height limitation herein
fixed. Walls and similar projections not used for human habitation, ex-
cluding signs, may extend above the height limitation not exceeding five feet.
Antennae structures and towers for private radio or television re-
ception and/or transmission (hereinafter referred to as "radio/television
structures") shall in no case exceed a maximum height of sixty-five (65) feet
measured from ground level to the highest point of such radio/television
structure. In the event the vertical dimension of any such radio/television
structure exceeds twelve (12) feet, the placement and location of such radio/
television structure shall be subject to the approval of the zoning administra-
tor, who shall coordinate his decision with the chief building inspector. The
zoning administrator shall employ the following standards and criteria in
determining whether to approve any proposed placement or location of such a
radio/television structure pursuant hereto:
(a) The placement or location must conform to all building restric-
tion lines and setbacks in the applicable zoning district.
(b) The placement or location should minimize any danger of per-
sonal injury or property damage to adjoining property owners and the applicant
in the event such radio/television structure should collapse or otherwise
become unstable.

(c) The placement or location should take advantage of existing
:opography, trees, structures and other obstructions to screen such radio/
television structure from adjoining and nearby property owners to the extent
possible, provided that the same does not prevent compliance with the
standards and criteria set forth in (a) and (b) hereinabove."
This ordinance shall take effect immediately upon its adoption by
the City Council of the City of Fairfax, Virginia.
