AN ORDINANCE AMENDING SECTION 3 OF THE ZONING ORDINANCE
TO PROVIDE FOR SECTION 3. 131:1 RELATING TO THE DISCLOSURE
OF EQUITABLE OWNERSHIP OF REAL ESTATE BY AN APPLICANT FOR
AMENDMENT TO, OR VARIANCE FROM, THE ZONING ORDINANCE.
IT IS HEREBY ORDAINED by the City Council of the City of Fairfax,
Virginia, that section 3 of the Zoning Ordinance of the City of Fairfax,
Virginia, be, and the same hereby is, amended to provide for section 3.131:1,
which reads in its entirety as follows:
3.131:1 Disclosure of legal and equitable ownership of real estate by applicant.
a) Any Applicant for a change in zoning, including but not limited
to an amendment to or variance from the zoning map, shall include as a part
of the application a statement on a form approved by the City Manager pro-
viding complete disclosure of the legal and equitable ownership in any real
estate to be affected by the requested change in zoning. In the case of
corporate ownership of real estate, the disclosure shall include the names of
stockholders, officers and directors and in any case the names and addresses
of all the real parties in interest; provided, however, that the requirement
of listing the names of stockholders, officers and directors shall not apply
to a corporation whose stock is traded on a national or local stock exchange
and having more than five hundred share holders.
b) The disclosure to be made pursuant to 'subsection a) of this
section shall be sworn to under oath before a Notary Public or other official
before whom oaths may be taken, and the form approved by the City Manager
shall so provide.
This ordinance shall become effective immediately upon its adoption.
