19770607 1977-21ORDINANCE NO. 1977-21 AN ORDINANCE TO AMEND SECTION 13-247 OF ARTICLE XI, CHAPTER 13 OF THE CODE OF THE CITY OF FAIRFAX, VIRGINIA, TO AMEND THE PAYMENT TO THE CITY TREASURER FOR VIOLATIONS IN LIEU OF OTHER PENALTIES. BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that section 13-247 of the Code of the City of Fairfax be, and hereby is, amended and reenacted to read as follows: "Sec. 13-247. Enforcement of article; payment to City Treasurer for violations in lieu of other penalties; respon- sibility for violations. "(a) It shall be the duty of the police officers of the City to police all parking meters; to enforce this article and to submit to the City Treasurer, at his office in the City, a written report of each violation or failure to comply with this article, stating: (1) The state license number of the vehicle occupying or having occupied the parking space adjacent to a parking meter in violation of any of the provisions of this article. (2) The identification number of the parking meter. (3) The date and approximate time of such violation. (4) Any other facts deemed pertinent to a thorough understanding of the violation. "(b) The police officer making the above-mentioned report shall also attach to such vehicle a parking citation notifying the owner thereof as follows: (1) That the vehicle has been parked in a manner that fails to comply with the provisions of this article. (2) That the sum of five dollars may be paid to the City Treasurer within thirty calendar days of the date of such parking citation, and, if such amount is paid within such time, no action shall be taken to prosecute the owner o operator of such vehicle for the violation of this article specified in such parking citation; otherwise, that the owner will be in violation of this article and the City Treasurer shall cause a warrant to be issued in due course 1977-21 -2 for such delinquent parking citation subjecting the owner or operator to the penalties provided in section 13-248 of this article. (3) That the City Treasurer shall certify, in writing on an appropriate form any contest by any person of any parking citation to the City general district court. The report and parking citation above provided shall bear cor- responding serial numbers and all blank reports issued hereunder shall be accounted for by the respective police officers. If the owner or operator of any vehicle parked in violation of or failing to comply with the provisions of this article shall, pursuant to such notice, pay the sum of five dollars to the City Treasurer, no action shall be taken to prosecute the owner or operator of such vehicle for such violation of this article. "(c) The owner of any vehicle parked in violation of or failing to comply with this article shall be prima facie responsible for such violation or failure."
