AN ORDINANCE TO VACATE A DEDICATED PUBLIC
STREET KNOWN AS "BIRCH STREET" AND TO VACATE
LOTS 16 THROUGH 26 IN THE PINEWOOD SUBDIVISION
LOCATED AT THE NORTHWEST INTERSECTION OF
JERMANTOWN ROAD AND ROUTES 29-211 PURSUANT TO
SECTION 15.1-482(b) OF THE 1950 CODE OF VIRGINIA,
AS AMENDED.
WHEREAS, Albert J. Dwoskin and Benedict Silverman, contract
purchasers of the hereinafter-described property, have heretofore
filed with this Council a written application, pursuant to
section 15.1-482(b) of the 1950 Code of Virginia, as amended,
to have vacated a part of a plat of the subdivision known as
"PINEWOOD", which plat of subdivision is recorded in Deed Book
559 at pages 476-477 among the land records of Fairfax County,
Virginia, more particularly described as all of a dedicated public
street known as "Birch Street" and Lots 16 through 26, inclusive,
in the subdivision known as PINEWOOD, located within the City
of Fairfax, Virginia; and,
WHEREAS, the said application, having been found by this
Council to be in proper form, was promptly referred to the Plannin
Commission of this City for its investigation and recommendations
thereon, and was duly advertised for public hearing before the
Planning Commission in the manner and for the time required by
section 15.1-431 of the 1950 Code of Virginia, as amended, and was
heard by the Planning Commission in public hearing pursuant to
such advertisement, and was duly advertised for public hearing
thereon before the Council in the manner and for the time required
by section 15.1-431 of the 1950 Code of Virginia, as amended; and,
WHEREAS, said public hearing on said application has been
this day held, and said City Council has considered the recommen-
dation of said City Planning Commission, duly filed, and the
evidence presented at the public hearing in connection with said
application, and has reached its decision on said application.

NOW, THEREFORE, BE IT ORDAINED that the said application be,
and the same hereby is, granted, and that the aforesaid part of
the plat of the subdivision known as "PINEWOOD" hereinbefore
more specifically described, including all of Birch Street and
Lots 16 through 26 of the said subdivision known as PINEWOOD, be,
and it hereby is, vacated. The Clerk is directed to cause a
certified copy of this ordinance to be recorded among the land
records of Fairfax County, Virginia, upon the expiration of thirty
days from the adoption hereof, if no appeal from the adoption
hereof has been filed within such time, or upon the ordinance being
upheld on appeal, whichever is later.
This ordinance shall take effect immediately upon its
passage by the City Council of the City of Fairfax, Virginia.
