AN ORDINANCE AMENDING CHAPTER 14
OF THE FAIRFAX CITY CODE
TO PROVIDE FOR A NEW SECTION 14~16.1
IT IS HEREBY ORDAINED by the City Council of the City of
Fairfax, Vir§inia, that Chapter 14 of the Code of the City of
Fairfax be, and the same hereby is, amended to provide for a new
Section 14-i6.1, which will read in its entirety as follows:
"Sec. 14-~16.1. Issuin~ bad Checks, etc.~ larceny,
"Any person who, with intent to defraud, shall make or draw
or utter or deliver any check, draft, or order for the payment
of money in the amount of less than $i00.00, upon any bank, bankinE
institution, trust company, or other depository~ knowin§, at the
time of such makin§, drawfn§, uttering or delivering, that the
maker or drawer has not sufficient funds in, or credit with, such
bank, banking institution, trust company, or other depository,
for the payment of such check, draft or order, although no express
representation is made in reference thereto, shall 5e guilty of
larceny.
"Any person who, under the provisions of this section, is
guilty of petit larceny shall be punishable for a Class 1
misdemeanor~
"The word "credit" as used herein~ shall be construed to me~
any arrangement or understanding with the bank, trust company~ or
other depository for the payment of such check, draft or order,"
This ordinance shall become effective immediately upon its
adoption.
