19760210 1976-8ORDINANCE NO. 1976-8 AN ORDINANCE TO REZONE FROM R-3 to C-2 87,008 SQUARE FEET OF LAND ON PREMISES KNOWN AS 3900 JERMANTOWN ROAD, AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. (Application No. Z-612-75-2) WHEREAS, Irene M. Stickley and John O. Duncan, Tr., owners, have heretofore filed with this Council a written application to have rezoned from R-3 to C-2 87,008 square feet of land on prem- ises known as 3900 Jermantown Road, and more specifically described as follows: Beginning at a point in the northwest line of Jermantown Road, Route 655, said point marks the southern corner of Thomas Bros. Construction Company; thence with the said northwest line of Jermantown Road, S 37© 23.7' W, 199.04 feet to a point marking the eastern corner of Swart; thence departing the said line of Jerman- town Road and with the northeast line of Swart, N 66© 17' W, 429.40 feet to a point in the southeast line of Froehlich and Williams, Trustees; thence with the said southeast line of Froehlich and Williams, Trustees, N 25© 29' E, 193.49 feet to a point marking the western corner of Thomas Bros. Construction Company; thence with the southwest line of Thomas Bros. Construction Company, S 66© 17' E, 471.03 feet to the beginning and containing 2.00 acres. WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required certi- fied plat and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this City for its investigation and recommen- dations thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and was heard by the Planning Co~m~Lission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and WHEREAS, said public hearing on said application has been this day held, and said City Council has considered the recommendations 1976-8 -2 of said City Planning Commission, duly filed, and the evidence pre- sented in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be and the same hereby is granted, and that the aforesaid land hereinbefore and in said application more specifically described be and it hereby is rezoned from R-3 to C-2 zone, as set forth and defined in the said Zoning Ordinance and amendments thereto, subject to the use regula- tions permitted in such C-2 zone, and that the Zoning Administrator of the City be and he hereby is directed to correct the Zoning Map heretofore adopted as part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be and she now hereby is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator and to the Planning Commission of this City as soon as possible.
