19750513 1975-19ORDINANCE NO. 1975-19 AN ORDINANCE TO REZONE FROM R-2 TO C-PD 9.3691 ACRES OF LAND LOCATED IN THE 3300 BLOCK OF PICKETT ROAD, AND TO ACCORDINGLY CORRECT THE ZONING ~P WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. (Application No. Z-604-74-2A) WHEREAS, R. J. L. Associates, owner, has heretofore filed with this Council a written application to have rezoned from R-2 to C-PD 9.3691 acres of land located in the 3300 block of Pickett Road, and more specifically described as follows: BEGINNING at a point marking the Southwesterly corner of Lot 1, Section 3-A, Mantua Hills, as recorded in D.B. 2638 at Page 233, among the land records of Fairfax County, Virginia, said point being on the Northerly line of Mantua Hills Swimming Asso- ciation; thence with the Northerly line of Mantua Hills Swimming Association and D. S. Mackall, III, N. 85© 22' 03" W., 384.33' to a point on the Easterly side of Pickett Road (Route 655), as dedi- cated with Section Eight, Mantua Hills; thence with the Easterly side of Pickett Road N. 00© 52' 49" W. 608.49' and N. 05v 59' 46" W. 214.49' to a point on the Southerly line of the property of the City of Fairfax; thence departing Pickett Road with the City of Fairfax line N. 84© 36' 06" E. 558.05' to a point marking the Northwest corner of Lot 21, Section Eight, Mantua Hills; thence with the Westerly line of Lot 21, S. 05© 24' 22" E. 125.01' to a point on the Northerly side of Prince William Drive; thence with said Drive S. 84© 35' 38" W. 48.00' to a point; thence with said Drive the same course continued with the Northerly line of Lot 20, Section Eight, Mantua Hills S. 05© 24' 22" E. 174.52' to a point on the City of Fairfax Corporation line; thence with the City of Fairfax Corporation line S. 11 23' 22" W. 111.42' to a point on the right-of-way of Brookings Court; thence with the right-of-way of Brookings Court with a curve to the left whose radius is 50.00' (and whose chord is S. 11© 23' 22" W. 78.63') an arc distance of 90.47' to a point on the aforementioned City of Fairfax Corporation Line; thence with the City of Fairfax Corporation Line S. 11v 23' 22" W. 125.20' to a point on the Northerly line of Lot 12, Section Eight, Mantua Hills; thence with the NorthErly and Westerly lines of Lot 12, N. 85© 22' 03" W. 14.63' and S. 04v 37' 57" W. 123.50' to a point marking the Southwesterly corner of Lot 12, said point also being on the aforementioned Corporation line; thence crossing Glen- brook Road and continuin~ with the Westerly line of Lot 1, Section ~3-A, Mantua Hills, S. 11v 19' 23" W. ].75.00' to the point of be- ginning containing 9.3691 Acres of land. WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required certi- fied plat, general develOpment plan and preliminary site plan, and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this City for its investigation and recommendations 1975-19 -2 thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required by the Zoning Ordi- nance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and WHEREAS, said public hearing on said application has been this day held, and said City Council has considered the recommendations of said City Planning Commission, duly filed, and the evidence pre- sented in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be and the same hereby is granted, and that the aforesaid land hereinbefore and in said application more specifically described be and it hereby is rezoned from R-2 to C-PD zone, as set forth and defined in the said Zoning Ordinance and amendments thereto, subject to the use regu- lations permitted in such C-PD zone, and that the Zoning Administra- tor of the City be and he hereby is directed to correct the Zoning Map heretofore adopted as part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be and she now hereby is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administra- tor and to the Planning Commission of this City as soon as possible. This ordinance shall take effect immediately upon its passage by the City Council of the City of Fairfax, Virginia. Adopted: May 13, 1975 Attest: City$Clerk
