19741210 1974-17ORDINANCE NO. 1974-17 AN ORDINANCE TO REZONE FROM C-1 TO C-3 21,479 SQUARE FEET OF LAND LOCATED IMMEDIATELY TO THE REAR OF MC DONALD'S RESTAURANT AT 10775 LEE HIGHWAY AND ADJACENT TO WEEL RADIO STATION AT 3909 OAK STREET, AND SHOWN ON CITY TAX MAP 57-1((14)) AS PART OF PARCEL 65, AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. (Application No. Z-605-74-2) WHEREAS, Fairfax Virginia Post 177 of the American Legion, Incorporated has heretofore filed with this Council a written appli- cation to have rezoned from C-1 to C-3 21,479 square feet of land located immediately to the rear of McDonald's Restaurant at 10775 Lee Highway and adjacent to WEEL Radio Station at 3909 Oak Street, and shown on City Tax Map 57-1((14)) as part of parcel 65, described as follows: Beginning at a pipe in the southeast line of Oak Street, said pipe marks the northwest corner of other lands of American Legion Post 177i thence with the said southeast line of Oak Street, N 21~ 21' 00" E, 137.84 feet to a pipe; thence continuing with the line of Oak Street, N 26© 33' 30" W, 90.43 feet to a pipe marking the southwest corner of Parcel 1, property of American Legion Post 177; thence de- parting the line of Oak Street and with the south line of Parcel 1, property of American Legion Post 177, N 63© 26' 30" E, 102.60 feet to a pipe in the west line of Fairfax County Board of Education; thence with the west line of Fairfax County Board of Education, S 06° 49' 30" E, 255.11 feet to a pipe marking the northeast corner of other lands of American Legion Post 177; thence with the north line of said other lands of American Legion Post 177, S 89© 12' 00" W, 131.85 feet to the beginning and containing 21,479 square feet. WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required map or blue- print and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this City for its investigation and recommen- dations thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1- 493 of the Code of Virginia of 1950, as amended, and was heard by the Planning Commission in public hearing pursuant to such advertise- ment, and was duly advertised for public hearing thereon before this Council in the manner and for the time required by the Zoning Ordi- nance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and 1974-17 -2 WHEREAS, said public hearing on said application has been this day held, and said City has considered the recommendations of said City Planning Commission, duly filed, and the evidence presented in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be and the same hereby is granted, and that the aforesaid land hereinbefore and in said application more specifically described be and it hereby is rezoned from C-1 to C-3 zone, as set forth and defined in the said Zoning Ordinance and amendments thereto, subject to the use regula- tions permitted in such C-3 zone, and that the Zoning Administrator of the City be and he hereby is directed to correct the Zoning Map heretofore adopted as part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be and she now hereby is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator and to the Planning Commission of this City as soon as possible. This ordinance shall take effect immediately upon its passage by the City Council of the City of Fairfax, Virginia. Passed: December 10, 1974 Attest: City Clerk
