AN ORDINANCE AMENDING SECTION 5 OF THE
ZONING ORDINANCE OF THE CITY OF FAIRFAX,
VIRGINIA BY ADDING A NEW SUBSECTION 5.12
RELATING TO A RESTRICTION OF THE AUTHORITY
OF THE BOARD OF ZONING APPEALS
IT IS HEREBY ORDAINED by the City Council of the City
of Fairfax, Virginia, that Section 5 of the Zoning Ordinance
should be and the same hereby is amended to provide for a new
Section 5.12 which will read in its entirety as follows:
Section 5.12:
The City Council hereby reserves to itself the right
to authorize any variance from the height limitation
found in any zoning category.
This ordinance shall take effect immediately upon its
passage.
