19720215 1972-5ORDINANCE NO. 1972-5 AN ORDINANCE TO REZONE FROM R-2 TO C-1 70,353 SQUARE FEET MORE OR LESS ON pREMISES KNOWN AS 4005 LOCUST STREET AND SHOWN ON CITY TAX MAP 57-4((2)) AS PARCELS 48 AND 138A AND TO ACCORD- INGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. (APPLICATION NO. Z-571-71-1-) WHEREAS, Constance F. Allen and Long Island Trust Company, trustee, owners, filed with this Council a written application to have rezoned from R-2 to C-1 70,353 square feet more or less on premises known as 4005 Locust Street and shown on City tax map 57-4((2)) as parcels 48 and 138A, described as follows: Beginning at a point at the intersection of the easterly right of way line of Locust Street with the southerly right of way line of Main Street, Route 236; thence, S 77 05' E 179.80 feet with the southerly right of way line of Main Street to a point at the northwesterly property corner of Lot 1, Singing Pines; thence, S 7© 15' 10" W 199.68 feet with a westerly property line of Lot 1, to a point at the northeasterly property corner of the Constance F. Allen Property; thence, N 76© 35' W 166.50 feet with the northerly property line of the Constance F. Allen Property to a point on the easterly right of way line of Locust Street; thence, N 3© 25' E 200.00 feet with the easterly right of way line of Locust Street to the beginning and containing 34,260 square feet of land; and Beginning at a point on the easterly right of way line of Locust Street at the southwesterly property corner of Lot 48, Singing Pines, said point being 200.00 feet southerly of the southerly right of way line of Main Street, Route 236; thence, S 76o 35' E 166.50 feet with the southerly property line of Lot 48, Singing Pines to a point on the westerly property line of Lot 1, Singing Pines; thence, S 5© 41' E 208.59 feet with a westerly property line of Lot 1, to a point at the northeasterly property corner of Lot 47A of a Resubdivision of Lot 47, Singing Pines; thence N 76© 35' W 200.00 feet with the northerly property line of Lot 47A to a point on the easterly right of way line of Locust Street; thence, N 3© 25' E 200.00 feet with the easterly right of way line of Locust Street to the beginning and containing 36,093 square feet of land. WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required map or blueprint and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this City for its investigation and recommendati¢ thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time required by the zoning 1972-5 Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, and WHEREAS, said public hearing on said application has been this day held, and said City has considered the recommendations of said City Planning Commission, duly filed, and the evidence presented in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be and the same hereby is granted, and that the aforesaid land hereinbefore and in said application more specifically described be and hereby is rezoned from R-2 to C-1 zone, as set forth and defined in the said Zoning Ordinance and amendments thereto, subject to the u~regulations permitted in such C-1 zone, and that the Zoning Administrator of the City be and he hereby is directed to correct the Zoning Map heretofore adopted as a part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be and she now hereby is directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator and to the Planning Commission of this City as soon as possible. This ordinance shall take effect immediately upon its passage by the City Council of the City of Fairfax, Virginia. Attest: Passed: February 15, 1972. - 2 -
