AN ORDINANCE TO REZONE FROM I-1 to C-2 5.7343 ACRES OF LAND
MORE OR LESS, I-OCATED TO THE REAR OF 9870 LEE HIGHWAY AND TO
THE SOUTH OF THE CITY PARK, AND SHOWN ON CITY TAX MAP
48-3((2)) AS PART OF PARCEl_ 2, AND TO ACCORDINGLY CORRECT THE
ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE
CITY OF FAIRFAX, VIRGINIA (APPLICATION NO. Z-578-72-2).
WHEREAS, Theodore R. Barker, owner, has heretofore filed with this
Council a written application to have rezoned from I-1 to I-2 5.7343 acres
of land more or less, located to the rear of 9870 Lee Highway and to the
south of the City park, and shown on City tax map 48-3((2)) as part of parcel
2 and described as follows:
Beginning at a monument at the southeast corner of City of Fairfax
Park, also being in the westerly line of Kiley and Swart; thence
along said line S17° - 09' - 45" W, 162.47 feet to a point; thence
through Lot 1N 88° - 20' - 01" W, 278.91 feet to a point; thence
SOO° - 10' - 52" W 158.93 feet to a point in the northerly line of
Boulevard Court, section 4; thence along said line S 78° - 36' -
00" W, 504.87 feet to a point in the easterly line of McPherson;
thence along the easterly boundary of McPherson the following
bearings and distances: N 18° - 211 - 50" W, 29.90 feet to a point;
NO7° - 28' - 20" E, 145.94 feet to a point; N 10° - 021 - 12" W,
40.69 feet to a point; also a corner to Stafford Builders, inc.;
thence along the easterly boundary of Stafford Builders, Inc. the
following bearings and distances: N 47° - 181 - 24" E, 37.80 feet
to a point; S 55° - 21' - 00" E, 65.03 feet to a point; N 32° -
09' - 00" E, 198.00 feet to a point; N 25° - 21' - 00" W, 82.00
feet to a point; N 66° - 09' - 00" E, 57.00 feet to a point; N 26° ~
21' - 00" W 51.00 feet to a point; S 73° - 49' - 00" W, 93.00 feet
to a point; N 28° - 51' - 00'~, 62.00 feet to a point; N 57° - 29' -
00" E, 60.00 feet to a point being a corner to City of Fairfax Park;
thence along said Park S76° - 42' - 32" E, 726.76 feet to the point
of beginning containing 5.7343 acres of land.
WHEREAS, the said application, having been found by this Council to
be in proper form and accompanied by the required map or blueprint and the
receipt showing payment of the fee required to be paid at the time of the
filing thereof, was promptly referred to the Planning Commission of this City
for its investigation and recommendations thereon, and was duly advertised for
public hearing before the Planning Commission in the manner and for the time
required by the Zoning Ordinance of this City, as amended, and by Section
15.1-493 of the Code of Virginia of 1950, as amended, and was heard by the
Planning Commission in public hearing pursuant to such advertisement, and was
duly advertised for public hearing thereon before this Council in the manner
and for the time required by the Zoning Ordinance of this City, as amended, and
by Section 15.1-493 of the Code of Virginia of 1950, as amended, and
WHEREAS, said public hearing on said application has been this day
held, and said Council has considered the recommendations of said City Planning
Commission, duly filed, and the evidence presented in connection with said
application at the public hearing, and has reached its decision on said
application,
NOW THEREFORE, BE IT ORDAINED that said application be and the
same hereby is granted for C-2 instead of I-2, and that the aforesaid land
hereinbefore and in said application more specifically described and hereby
is rezoned from I-1 to C-2 zone, as set forth and defined in the said Zoning
Ordinance and amendments thereto, subject to the use regulations permitted
in such C-2 zone, and that the Zoning Administrator of the City be and he
hereby is directed to correct the Zoning Map heretofore adopted as a part of
the Zoning Ordinance to properly show such change in the zoning of said land,
and that the Clerk of this Council be and she now hereby is directed to
transmit duly certified copies of this ordinance to the applicant, Zoning
Administrator and to the Planning Commission of this City as soon as possible.
This ordinance shall take effect immediately upon its passage by
the City Council of the City of Fairfax, Virginia.
