19710316 1971-6 ORDINANCE NO. 1971-6 AN ORDINANCE TO REZONE FROM M-1 TO C-1 3.21684 ACRES MORE OR LESS ON PREMISES KNOWN AS 10560 MAIN STREET AND SHOWN ON CITY TAX MAP 57-2-((2)) AS A PART OF PARCEL 156 AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. (APPLICATION NO. Z-564-71-3) WHEREAS, The Secretary of Housing and Urban Development, Federal Housing Administration, owner, has heretofore filed with this Council a written application to have rezoned from M-1 to C-1 3.21684 acres more or less on premises known as 10560 Main Street and shown on city tax map 57-2-((2)) as a part of parcel 156, described as follows: Beginning at a point in the northerly line of State Route 236 (Main Street) said point being a common corner to the lands of Vepco; Thence running with the common lines of Vepco and Keith, Trustee, et al, N 39© 19' 30" E 262.47 feet to a point; Thence running through the land of the Mosby Apartments S 56© 44' 25" E 513.33 feet to a point in the common line to the Truro Episcopal Church; Thence running with the common line to the Truro Episcopal Church S 33© 08' 40" W 84.57 feet and S 23© 10' 57" W 179.20 feet to a point in the northerly line of State Route 236; Thence running with the northerly line of State Route 236 N 56© 44' 25" W 572.66 feet to the point of beginning and con- taining 3.21684 acres more or less. WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required map or blueprint and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this City for its investi- gation and recommendations thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time required by the zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required by the Zoning Ordinance of this city, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended; and WHEREAS, said public hearing on said application has been this day held, and said city has considered the recommenda- tions of said city Planning Commission, duly filed, and the evidence presented in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be, and the same hereby is, granted and that the aforesaid land hereinbefore and in said application more specifically described be, and hereby is, rezoned from M-1 to C-l, as set forth and defined in the said zoning Ordinance and amendments thereto, subject to the use regulations permitted in such C-1 zone, and that the zoning Administrator of the city be, and he hereby is, directed to correct the Zoning Map heretofore adopted as a part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be, and she now hereby is, directed to transmit duly certified copies of this ordinance to the applicant, zoning Administrator and to the Planning Commission of this city as soon as possible. This ordinance shall take effect immediately upon its passage by the city Council of the City of Fairfax, Virginia. Passed: March 2, 1971. Attest: ~erk
