AN ORDINANCE TO REZONE FROM C-2 TO I-2 3.59 ACRES MORE
OR LESS ON PREMISES KNOWN AS 11140 LEE HIGHWAY AND SHOWN
ON CITY TAX MAP 57-1-((2))-31 AND TO ACCORDINGLY CORRECT
THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE
OF THE CITY OF FAIRFAX, VIRGINIA. (APPLICATION NO. Z-
556-70-1.)
WHEREAS, Wayne Johnson, contract owner, has heretofore filed
with this Council a written application to have rezoned from C-2 to I-2
5.3 acres of land at lll40 Lee Highway and more particularly described
on City tax map 57-1-((2))-31, described as follows:
"Beginning at a point in the northerly R/W line of Lee Highway
(State Routes 29 & 211) and the southeasterly corner of Teal; thence
with Teal, and the same line continue with Green and Vepco N 22° 40' E
798.55 Ft. to a point, a corner of Vepco and in the line of English; thence
with English S 60° 07' E 163.31 Ft. to a point being the southeasterly
corner of English; thence with the easterly line of English N 24° 08' E
207.71 Ft. to a point in the southerly R/W line of Lee-Jackson Memorial
Highway (Route 50); thence leaving English and with the southerly line of
the said Lee-Jackson Memorial Highway S 58° 52' E 100.47 Ft. to a point
being the northwesterly corner to a cemetery; thence leaving the said
highway and with the cemetery S 03° 45' W 224.75 Ft. to a point being the
southwesterly corner to the said cemetery; thence with the southerly line
of the cemetery S 60° 07' E 3.90 Ft. to a point being a northwesterly
corner to Copland; thence with the westerly line of Copland S 25° 32' W
281.70 Ft. to a point and S 09° 00' W 108.31 Ft. to a point in the line
of Cohen; thence with the northerly line of Cohen the following courses
and distances: N 81° 10' W 82.88 Ft. to a point N 09° 44' E 12.22 Ft. to
a point, S 86° 55' W 71.25 Ft. to a point and S 24° 22' W 231.50 Ft. to a
point in the northerly R/W of the said Lee Highway, thence with northerly
side of Lee Highway S 86° 30' W 222.80 Ft. to the place of beginning and
containing 5.3 acres, more or less."
WHEREAS, the said application, having been found by this Coun-
cil to be in proper form and accompanied by the required map or blueprint
and the receipt showing payment of the fee required to be paid at the time
of the filing thereof, was promptly referred to the Planning Commission of
this City for its investigation and recommendations thereon, and was duly
advertised for public hearing before the Planning Commission in the manner
and for the time required by the Zoning Ordinance of this City, as amended,
and by Section 15.1-493 of the Code of Virginia of 1950, as amended, was
heard by the Planning Commission in public hearing pursuant to such adver-
tisement, and was duly advertised for public hearing thereon before this
Council in the manner and for the time required by the Zoning Ordinance of
this City, as amended, and by Section 15.1-493 of the Code of Virginia of
1950, as amended; and

WHEREAS, said public hearing on said application has been this
day held, and said City has considered the recommendations of said City
Planning Commission, duly filed, and the evidence presented in connection
with said application at the public hearing, and has reached its decision
on said application,
NOW THEREFORE, BE IT ORDAINED that the said application be, and
the same hereby is, granted in part, and that the following described land
be, and hereby is, rezoned from C-2 to I-2 Zone, as set forth and defined
in the said Zoning Ordinance and amendments thereto, subject to the use
regulations permitted in such I-2 Zone, to wit:
"Begi~nning at a point in the northerly R/W line of Lee Highway
(State Routes 29 & 211) and the southeasterly corner of Teal; thence
with Teal, and the same line continue with Green and Vepco N 22° 40' E
?98.55 to a point, a corner of Vepco and in the line of English; thence
with English S 60° 07' E 162.31 Ft. to a point being the southeasterly
corner of English; thence with the easterly line of English N 24° 08'
E 207.71 Ft. to a point in the southerly R/W line of Lee-Jackson Memorial
Highway (Route 50); thence leaving English and with the southerly line
of the said Lee-Jackson Memorial Highway S 58° 52' E 100.47 Ft. to a point
being the northwesterly corner to a cemetery; thence leaving the said
highway and with the cemetery S 03° 45' W 224.75 Ft. to a point being the
southwesterly corner to the said cemetery; thence with the southerly line
of the cemetery S 60° 07' E 3.90 Ft. to a point being a northwesterly

Less and except the following:
"Beginning at a point in the southerly line of Lee-Jackson
Memorial Highway and being the northeasterly corner of English; thence
with said highway S 58° 52' E 100.47 Ft. to a point being the north-
westerly corner to cemetery; thence S 03° 45' W 224.75 Ft. to a point
being the southeasterly corner to the said cemetery; thence departing
and running through said property N 60° 58' 54" W 178.65 Ft. to a point
being a corner to English; thence with the line of English N 24° 08' E
207.71 Ft. to place of beginning containing 0.65 acres, more or less,
(28,511 square feet);"
and less and except the following:
"Beginning at a point in the northerly R/W line of Lee Highway
(State Routes 29-211) and the southeasterly corner of Teal; thence with
the line of Teal N 22° 40' E 228.02 Ft. to a point in said line; thence
departing and running theough said tract N 86° 30' E 230.47 Ft. to a point
in the line of Cohen S 24° 22' W 251.50 Ft. to a point in the northerly
R/W of said Lee Highway - 29, 211; thence with northerly side of Lee High-
way S 86° 30' W 222.80 Ft. to the place of beginning and containing 1.06
acres, more or less, (46,~47 square feet)."

BE IT FURTHER ORDAINED that the Zoning Administrator of the
City be, and he hereby is, directed to correct the Zoning Map heretofore
adopted as a part of the Zoning Ordinance to properly show such change in
the zoning of said land, and that the Clerk of this Council be, and she
now hereby is, directed to transmit duly certified copies of this ordinance
to the applicant, Zoning Administrator, and to the Planning Commission of
this City as soon as possible.
This ordinance shall take effect immediately upon its passage
by the City Council of the City of Fairfax, Virginia.
