19700908 1970-19ORDINANCE NO. ]970-]9 AN ORDINANCE TO REZONE FROM C-2 to I-2 56,431 SQUARE FEET MORE OR LESS ON PREMISES KNOWN AS 4069 AND 4073 JERMANTOWN ROAD AND SHOWN ON CITY TAX MAP 57-1-((2)) AS PARCEL 14 AND PART OF PARCEL 19 AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. (APPLICATION NO. Z-559-70-1.) WHEREAS, M. G. & Katherine M. Britt, owners, have heretofore filed with this Council a written application to have rezoned from C-2 to I-2 56,431 square feet more or less on premises known as 4069 and 4073 Jermantown Road and shown on City tax map 57-1-((2)) as parcel 14 and part of parcel 19, described as follows: "Beginning at a monument on the easterly side of Jermantown Road, Route 655, a corner to VEPCO; thence with said side of said Road, N 07° 02' 45" W 182.43' to a pipe set and N 02° 14' 43" E 119.45' to a monument, a corner to VEPCO, said monument being S 02° 06' 40" W 53.75' from a monument; thence with the lines of VEPCO, S 80° 42' 05" E 194.27' to a pipe set, said pipe being S 03° 54' 45" E 42.00' from a pipe found and thence S 03° 54' 45" E 242.62' to a pipe found, a corner to VEPCO; thence with VEPCO S 81° 56' 52'~' W 192.47' to the beginning, containing 53,568 square feet." And "Beginning at a monument on the easterly side of Jermantown Road, Route 655, a corner to now or formerly Marshall; thence with said side of said Road, N 12° 20' 05" W 15.03' to a monument, a corner to Thomas Aquillo, et al; thence with the line of Thomas Aquillo, et al, N 81° 56' 52" E 192.47' to a pipe found, a corner to VEPCO; thence running through VEPCO property, S 03° 54' 45" E 14.98' to a pipe set in the line of now or formerly Colbert; thence with the line of Colbert and the same line continued with now or formerly Marshall, S 81° 55' 55" W 190.27' to the beginning, containing 2,863 square feet." WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required map or blueprint and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this City for its investigation and recommenda- tions thereon, and was duly advertised for public hearing before the Planning Commission in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required by the Zoning Ordinance of this City, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended; and " 1970-19 -2 WHEREAS, said public hearing on said application has been this day held, and said City has considered the recommendations of said City Planning Commission, duly filed, and the evidence presented in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be, and the same hereby is, granted and that the aforesaid land hereinbefore and in said application more specifically described be, and hereby is, rezoned from C-2 to I-2 Zone, as set forth and defined in the said Zoning Ordinance and amendments thereto, subject to the use regulations permitted in such I-2 Zone, and that the Zoning Administrator of the City be, and he hereby is, directed to correct the Zoning Map heretofore adopted as a part of the Zoning Ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be, and she now hereby is, directed to transmit duly certified copies of this ordinance to the applicant, Zoning Administrator and to the Planning Commission of this City as soon as possible.
