19701215 1970-29 ORDINANCE NO. 1970-29 AN ORDINANCE TO REZONE TO C-2 THE R-2 AND R-3 PORTIONS OF A TRACT CONTAINING 64,933 SQUARE FEET MORE OR LESS SHOWN ON CITY TAX MAP 57-2-((2)) AS PARCELS 165 AND 165A AND TO ACCORDINGLY CORRECT THE ZONING MAP WHICH IS A PART OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIRGINIA. (APPLICATION NO. Z-562-70-2.) WHEREAS, Arbor Facilities Corporation, owners, have heretofore filed with this Council a written application to have rezoned to C-2 the R-2 and R-3 portions of a tract containing 64,933 square feet more or less shown on city tax map 57-2-((2)) as parcels 165 and 165A described as follows: "Beginning at a point at the corner of North Street and chain Bridge Road (formerly Payne Street) and running thence with the easterly boundary of Payne Street N. 06© 42' 53" E. 92.84 feet; thence N. 07© 42' 56" W. 191.25 feet; thence N. 82© 17' 04" E. 10 feet; thence N. 07© 42' 56" W. 50 feet to a point in the line of the property belonging to Fairfax County; thence with the line of Fairfax County N. 82© 17' 04" E. 194.80 feet to the line of Allen C. Adams, et al; thence with the line of Adams S. 08© 46' 40" W. 52.15 feet; thence S. 07© 42' 56" E. 151.98 feet; thence S. 14© 25' 56" W. 200 feet to a point in the northerly boundary of North Street; thence with the line of North Street N. 75© 34' 04" W. 148.70 feet to the point of beginning. Containing 64,933 square feet." WHEREAS, the said application, having been found by this Council to be in proper form and accompanied by the required map or blueprint and the receipt showing payment of the fee required to be paid at the time of the filing thereof, was promptly referred to the Planning Commission of this city for its investigation and recommendations thereon, and was duly advertised for public hear- ing before the Planning Commission in the manner and for the time required by the zoning Ordinance of this city, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended, was heard by the Planning Commission in public hearing pursuant to such advertisement, and was duly advertised for public hearing thereon before this Council in the manner and for the time required by the zoning Ordinance of this city, as amended, and by Section 15.1-493 of the Code of Virginia of 1950, as amended; and 1970-29 WHEREAS, said public hearing on said application has been this day held, and said city has considered the recommendations of said city Planning Commission, duly filed, and the evidence presented, in connection with said application at the public hearing, and has reached its decision on said application, NOW THEREFORE, BE IT ORDAINED that said application be, and the same hereby is, granted and that the aforesaid land hereinbefore and in said application more specifically described be, and hereby is, rezoned from R-2 and R-3 to C-2, as set forth and defined in the said zoning ordinance and amendments thereto, subject to the use regulations permitted in such C-2 Zone, and that the zoning Administrator of the city be, and he hereby is, directed to correct the zoning Map heretofore adopted as a part of the zoning ordinance to properly show such change in the zoning of said land, and that the Clerk of this Council be, and she now hereby is, directed to transmit duly certified copies of this ordinance to the applicant, zoning Administrator and to the Planning Commission of this city as soon as possible.
