19691202 1969-16 ORDINANCE NO. 1969-16 AN ORDINANCE AMENDING AND RE-ENACTING SECTION 3.172 OF THE ZONING ORDINANCE OF THE CITY OF FAIRFAX, VIR- GINIA, TO DESIGNATE THE DIRECTOR OF PUBLIC WORKS AS THE CITY OFFICIAL WITH RESPONSIBILITY FOR PROCESSING SITE PLANS BE IT ORDAINED by the City Council of the City of Fairfax, Virginia, that Section 3.172 of the Zoning Ordinance of the City of Fairfax, Virginia, be amended and re-enacted to read in its entirety as follows: "3.172 Procedure: a. The owner or developer shall submit to the Director of Public Works a site plan prepared and certified by an engineer, architect or land surveyor, as defined by this ordinance. Seven prints of the site plan at a scale of not less than one inch equals fifty feet, together with all information required by this ordinance shall be submitted. All plans shall be on either twenty-four inch by thirty-six inch material or suitable for folding to that size. b. Notice required: Prior to consideration by the Director of Public Works, the applicant shall notify in writing five property owners in the immediate vicinity of the site involved, two of whom shall be owners of property adjoining the site, that the site plan has been filed and will be considered by the Director of Public Works ten days after receipt of the notice. Postal receipts of certi- fied mail attached to a copy of the notice shall be sufficient proof of delivery. c. Objections to the approval of a site plan may be filed with the Director of Public Works by anyinterested party and shall be filed in writing within the period prescribed in the notice. d. The Director of Public Works shall notify the appli- cant and any objectors of his decision to approve or disapprove the applicant's site plan. An appeal from any final decision of the Director of Public Works shall be made to the Board of Zoning Appeals pursuant to law." This ordinance shall become effective immediately upon its passage by the City Council of the City of Fairfax, Virginia. Passed: December 2, 1969. Attest: Ci~/Clerk - 2 -
